    You MUST contact the PPC informing them that you were the driver on the day. Include some sort of appeal, anything to get a POPLA code.

    Guys,

    No news back yet but thought I would post the wording of my appeal.


    I write in respect of the speculative invoice left on the above vehicle on November 4, 2013. In the first instance I would advise you that this is a lease vehicle and that I shall be assuming responsibility for dealing with this matter.

    Please be advised that I contest the charge that you are seeking in respect of this vehicle being parked on the Texaco siteon November 4th for the following reasons;

    1) The driver, as a customer of Texaco, had a legitimate reason for being on the premises.

    2) The alleged parking ‘restriction’ in respect of the area where the car was parked is not indicated by any road markings and therefore it is not reasonable for the driver to be aware of same.

    3) If there was a breach of contract, which is strongly contested, I dispute the fact that a charge of £50 represents actual losses incurred by the land owner, is not a genuine pre-estimate of loss and that it is, in fact, punitive.

    I therefore request that this speculative charge be cancelled. In the event that this appeal is rejected you are requested to provide me with a POLA code. Furthermore, you are advised that I will seek to recover from ANPR Ltd any costs incurred by me, including my time, indealing with any correspondence other than a confirmation that this appeal has been accepted.

  • DO NOT say it's a lease car. That will give them an excuse to pretend they never received your appeal (yes, they do "lose" post when convenient to them), and go after the lease company with a better chance of getting their money.

    Never say anything in correspondence with PPCs which isn't strictly necessary. All it does is provide them rope to hang you by.

    Oops! Letter mailed a week ago. I have already discussed this with the leasing company, a small outfit with whom I have a good relationship and they have confirmed that they will just identify me as the keeper, which I believe is all that they are obliged to do.

    Be ready for ANPR Ltd's tricks of hiding a POPLA code or sending a stalling letter first which doesn't make it clear that they have put the ball in your court. Respond to everything until they give you a POPLA code and do not let it lie.

    Also once you get a 10 digit POPLA code, it's for POPLA (not for writing back to N Martin)! We will help you word a winning POPLA appeal to beat this lot if you can wheedle the POPLA code out of them.

    How long do I give ANPR to respond? I sent my appeal in on November 11th.

    They've got 35 days generally speaking. They need to acknowledge within 14 days. But since ParkingEye have pressured the BPA to change the CoP on the 35 days it has become a bit of a movable feast.

    But this is ANPR where rules mean zilch. Leave it until the 35 day point, send them a reminder and complain bitterly to the BPA about their, yet again, disregard for the correct way of doing things.

    You've identified to them that it's a leased car, I would put my house on that you'll hear from the lease company about this before ANPR Ltd, our Trev (owner of ANPR) is a barrel scraping long winded douch, he tries everything to get lease companies to pay!

    One case is that driver had appealed, it was rejected by them, so a hidden popla code was given, popla confirmed to both parties that an appeal was given, they went to the lease company in breach of pofa 2012 and managed to squeeze payment from them.

    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    I have received a reply! Without re-typing the whole thing here it basically explains there referencing system for raising the ticket and then goes on to say;

    * We never quash a ticket in cases where a vehicle has been ticketed for parking in a no-waiting area.

    * Although they sympathise, they are appointed by the landowner to enforce their T&C's

    * Should I wish to appeal further it would nullify any discount that remains and could I may incur further costs.

    * If I wish to continue with my appeal I am requested to write again and they will provide me with POPLA details.

    It will not surprise you to know that no response was made to my comment re the pre-estimate of costs. I will start working on my reply and any suggestions would be welcome.

    Without reading the thread ... I presume you're still at initial appeal to PPC stage? If yes then the PPC is simply using typical stalling tactics. Just reply to them along the lines of:

    Dear PPC Scum,
    Thank you for your irrelevant letter dated [date] in relation to my Appeal dated [date] to your speculative invoice [ref] dated [date]. You have already received my appeal. Any further communication from yourself will be deemed harassment unless it either:

    a) Rejects my appeal and contains a POPLA code, OR

    b) Confirms my appeal has been accepted and the speculative invoice is cancelled.

    Your lack of compliance with the BPA Code of Practice will be reported to Steve Clark at the BPA and to the DVLA.
