  • Well it's now over 2 weeks past my hearing date and I haven't heard anything from POPLA or seen an evidence pack from VCS. Not sure if I should contact POPLA or just let it ride...

    I would email popla and check if it has been dealt with or not, if not ask them if they have a new hearing date

    Well today i received an email from popla with the VCS evidence pack attached. I actually got 2 emails as the second one was a video of the car stopping. they have put loads of evidence forward including a heavily redacted copy of the contract. One thing I do note on this agreement is that everything is typed out apart from the dates of the agreement which are all hand written.

    Do I just sit and wait now for a decision?
  • As you have an all singing & dancing patent MSE appeal you need do nothing, though if you have a look at what has been sent, if all they have sent is the contract and video, you will probably find it does not contain any explicit wording assigning the right to take legal action. Check its dates and see if there are any obvious lies like a date after your infraction or that it is for a different site in which case you could contact POPLA pointing this out. See if there is anything that surprises you in the remnants of the contract that you might want to share with us.

    Here's one anomaly..

    D: Registered Keeper Details and Liability Trail

    The Parking Charge Notice was issued under paragraph 6 (1) (b) of the Protection of Freedoms Act 2012; as such the Registered Keeper’s details were requested from the DVLA 2 days after the contravention was observed. The Registered Keeper’s details were received from the DVLA on 1st November 2013.

    An appeal from the Registered Keeper Mr XXXXXXXX (the appellant) was received on 3rd November 2013. He failed to confirm to Vehicle Control Services Ltd who the driver of the vehicle was on the day in question or supply a serviceable address for that driver. Under the Protection of Freedoms Act 2012 by failing to provide those details, the appellant became liable for the Parking Charge Notice.

    Stop reading their drivel and sit back and wait to win, because you may have noticed - I hope, because it's obvious - their 'breakdown' of the charge is not a GPEOL. It's operating costs and a write-off allowance. They lose with it every time at POPLA!
