    It would help if you were more specific about the set-up where you will be living:

    * will your landlord live in the same property?
    * share facilities/space?
    * use same front door?

    Once you have established if you will be a tenant, or a lodger, it is easier to advise on your liabilities and rights (and those of the landlord.

    yes, but he's hardly ever there. but it is his primary residence. yes he will share kitchen and sitting room. the 2 bedrooms me and my daughter will rent have ensuite bathrooms though so we won't all share bathrooms. yes he will use same front door.

    thankyou. but all over mumsnet, every london parent has virtually screamed at me that the only way to get admission to london schools is to have a council tax bill in my name for years previous to admission date. it makes you want to throw in the towel and home school hearing all this!!! well. not quite, but you know what i mean. you really think tenancy agreement is enough? i am SO confused
  • OOec25, no, it's a floor, but no exclusive access. he can walk through the floor to reach his rooms etc. the floor has a mezzanine level with his office on it anyway. there is no locked door separating us.

    In which case it sounds like you will be a lodger. This means not real security of tenure; he can give you reasonable notice unless this is defined in your lodging agreement.

    If the full rent and your contribution to all other bills is below the rent a room limit, then he pays no tax. But that is only about £370 per month which is very low for London.

    Lodgers names do not go on CT bills. He could put you on the electoral roll.

  • and yes, me and the baby are the only lodgers he will have. so, if i were to present to him in a few bullet points, our reasons for not being turfed out after 1 year....could you post them?? 1000 thanks

    Not really.

    Your LL has the right to decide whether he wants you living in the house and to ask you to leave any time he wants to. Not much you can do about that.

  • For £15000 a year can't you find a decent place with a proper secured tenancy?
  • finally can i ask, now i have established i am officially to be "lodger", and won't pay council tax, will his single-person council tax reduction be swiped away, or will it not be affected by me living there?

    He won't be able to claim a single person's living allowance as there will be 2 adults living in the property.
