Faulty Phone - ask for a different model?

Hi, I took out a new contract with Three in mid/end July and received a HTC 8x phone, which I quite like...however, this will be the second time since taking out my contract that I have had to send my phone to HTC to be repaired due to a known fault with the phones charging cycle. Once the battery has been fully depleted, the phone will no longer charge.
Is this something I will have to put up with for the duration or is there any chance that Three CS will 'swap' my phone for a different model on a similar plan? I've never contacted Three about the issue, but have dealt with HTC directly both times.
I understand this is maybe slightly extreme, but the turnaround takes 2 weeks to repair my phone, so thats 4 weeks without a handset in the 3 1/2 months I've had my contract so far.
( for anyone interested Google HTC 8x boot loop for the issue ).

You can ask - but I doubt they'll say yes.
A repair costs Three nothing (the manufacturer is bearing the repair cost, and a repair is still much cheaper than a replacement). If Three were to give you a new phone that would have to come straight out of their pocket.Nothing I say represents any past, present or future employer.0 -

No, Three would likewise be entitled to a refund from its supplier, given that the goods are not of satisfactory quality.
Depends entirely on the contract, some distributors will discount an item if the retailer assumes all warranty costs. The retailers gambling they won't get returns Vs a keener price.
B2B contracts don't always follow the same rules as consumer contracts.0
