car insurance companys duty of care???

I have my car insurance with onecall insurance. Paid the deposit when I signed up and then had monthly installments there after... after checking my online banking noticed my direct debit had been cancelled in sept...and they had recieved no payments for the 3 months before despite money being in my account....during this time I have recieved no letters informing me of mist payments and when I spoke to them on the phone they was unaware I hadnt paid amd have said thats why no letters were sent.. so now am 480 behind and they are askin for a payment to clear or my monthly payments will go up quite alot. Am just wondering by law do they have to notify me when a payment has not gone through cause effectively have been driving around for 4 months having not paid any insurance (though still insured).

    No laws have been broken.

    You just had a free loan for 4 months.

    Looks like they are being helpful letting you pay what you owe on the drip.

    Were you paying the insurer directly, or was the annual premium paid by a third-party and your payments should have been made to them?

  • Obviously wasnt unaware as were tryin take payments have checked all the dates and money was in my account.. surely after it not going through a phone call or a letter then problem fixed
  • All they said was they wasnt made aware... but after this long even a cancellation letter would have brought my attention to it

    It's all sorted now, you were fully insured throughout.

    They have offered you the option of spreading the missed payments.

    You have had the benefit of all this. They haven't broken the law.

    If you want to prolong it, complain to them about their poor admin, but as you haven't been affected by it, what is your gripe?
  • Cause what was already a costly insurance will go up alot. Have had benefit for a few months yes but will pay out the nose for it now for 8 months. The reason I choose monthly cause it spreads the cost and is more managable for me now is alot less

    OK - you agree you had the benefit, but now have to pay. How do you want them to respond?

    But they are letting you pay over 8 months.

    Surely you should still have the money that you didn't pay for the 4 months in your account. As you weren't expecting it to be there you won't have spent it will you?
