Right to return an item i'm dissatisfied with

Bought a new vacuum in July that was supposed to be good for pet hair. It isn't. Suffered with it then decided to return to Argos. The customer assistant said to ring the Vax helpline - I wasn't happy with this and talked about the Sale of Goods Act. Spoke to the manager who wasn't bothered and was insistent that I ring Vax. I then posted on Facebook. The Argos rep told me to go to the branch. I explained that I'd already spoken to the manager and he was unhelpful. Where do I go with this now? I really object to having to ring a helpline when as far as I'm aware I should be dealt with directly by the retailer and not by the manufacturer

I would write to Argos and ask for a refund as the good were not as described or fit for the purpose.
  • I can't believe the hoops I'm having to jump through. Never had such a terrible experience as this before. Argos have always been very good at customer service in the past

Go back to store and stand your ground until you get a refund.

Has it taken 4 months for you to decide it was not suitable?

Yeah the fact it's taken you four months to decide it rubbish counts against you. If you had taken it back straight away you would have been fine but 4 months is pushing it a bit.

As you have had it for four months I am not surprised you are having to 'jump through hoops'

It isn't faulty. Its just not as good as you would like it to be. Fair enough, but do you really think you should have four months to reach that conclusion?

All of this 'stand your ground until you get a refund' is nonsense. At the moment you are in no way entitled to anything. Anything they do offer will be goodwill, so getting shirty, talking about the soga (which is irrelevant in this case) will see your chances of a goodwill gesture getting smaller and smaller.

The vax is probably blocked that's why it's not performing well.
  • I appreciate it's taken me a while to return it. I didn't start using it til August. However, it's become a point of principle. From the minute I walked into the store they weren't interested in when I'd bought it. Apparently on some makes they no longer do exchange / repair / refund in store, you have to ring the manufacturer. This, to me, is wrong and whether I get something done about my vacuum is neither here nor there. It's irritated me that Argos seem to be flouting the law by insisting that customers contact the manufacturer rather than dealing with it in the place that it was purchased

They are not 'flouting' the law. You have no automatic right to exchange and a refund, and perhaps not even a repair. It is not faulty. Argos have done nothing wrong except sell you a product, 4 months ago, which you dont like anymore.

As for not 'repairing' in store, I can only assume I am misunderstanding you, but do you really think Argos have a Vax engineer, and a Sony specialist, and a Flymo guy (repeat for every brand they sell) they cannot possibly repair 'in store' all they wuld do, with a faulty item, is send it to the manufacturer. In most cases it is much easier for the consumer to do this directly (and often they have way more joy going direct to the manufacturer)

Anyway, this is irrelevant as Argos owe you nothing. This is a change of mind purchase. It is not faulty. Even if you had returned it within an hour of buying it you would have no 'legal' right to a refund (but I assume Argos has a fairly good refund policy, but legally, no)

As far as Argos are concerned it could be blocked, you could have won a better vacuum in a raffle, you could no longer have the pet you needed the Vax for! You have had it four months, its not faulty, and its nothing to do with Argos anymore.

Could I ask, is the vacuum cleaner just a sucker version, if so, buy a brush thingy for it.

We had a Henry, and inherited a long hair cat, oh dear, we have a rug that was just so hard work. someone suggested that we get a brush/beater attachment and it took every single cat hair out at one sweep, we have to clean the brush on a weekly basis but that is easy peasy compared to the frustration we had before.
make the most of it, we are only here for the weekend.
and we will never, ever return.
