My request to Easyjet for recent flight compensation (flight STN to PMI) delayed more than 3 hours, was rejected. Please read the following response from Easyjet.

Email respones:-
Thank you for your e-mail and apologies for the delayed response.
I am sorry to learn about your flight delay and I apologise for the inconvenience caused. We make every effort to deliver an efficient service to all our passengers.
I have checked our records of your flight EZY3215 on the 18th of October 2013 and confirm that your flight was delayed for 3 hours and 9 minutes due to brake failure. As per our Carrier Rand European Union laws, this delay has been classified as 'extraordinary' reason, which means that this was our of our direct control.
The European Union Compensation is only processed if the flight delay is classified as 'non-extraordinary' reason. As your flight was delayed due to extraordinary reason, I am afraid that I am unable to process the European Union Compensation as per your request.
I hope this will not deter you from using our service as we do respect and value your loyalty and customs.

So is a brake failure is classified as 'non-extraordinary' ????
Are Easyjet correct, or should I still receive compensation

Technical failures are unlikely to be regarded as extraordinary circumstances, according to European law and recent UK county court judgements. But you may need to take easyJet to court to get compensation, and you'll need to do a lot of reading up. Start with the FAQs on page one of the easyJet thread and post any specific questions there.

It really irritates me when you read a response like this. It's incoherent nonsense obviously written by someone who knows zilch about the law and had just been told to send a rejection response peppered with the words European Union and Extraordinary.

    Pathetic.
