Fuel leak reason for non payment of compensation by Monarch

Our Monarch flight from Gatwick to Malaga on the 18th July was delayed by 6 hours. I have submitted a claim, to be told that it has been refused as "...the flight suffered a fuel leak during its previous sector..."
I would have thought a fuel leak was a 'technical fault' and hence the responsibility of the airline.
I would like to ascertain the validity of this excuse before taking the matter further.
I seem to recall finding a site previously which gives reasons why particular flights were detained.
anyone any ideas?

Read about Huzar in the FAQ thread, then advise Monarch that you are aware of Judge Platts comments and please can they just process payment to you.
