contract issue

Hi guys really need some advice/help bear with me

Basically took out a Vodafone contract in early august when I recieved parcel there was no phone inside so spoke to carphonewarehouse and they said they would send claim form out after sending it back I spoke to them again and they said they had received form and would file a dispute and I don't have to do anything further. However last month recieved a bill from voda spoke to them and they said the contract had not been cancelled and to speak to carphonewarehouse. Spoke to them and now they saying they never recieved form so contract never got cancelled. What do I do I have a SIM that is still sealed but no phone and have to pay 35 a month line rental

Go back to carphone warehouse and insist they either issue replacement handset or cancel contract at there cost

They saying that I did not follow procedure as they never recieved form and if I did to send proof of postage.and if I never heard anything after a few weeks I should have chased it up.I tried explaining that I never ever used the SIM as there was no phone
