Paying by bank transfer instead of credit card

Hi,

I am getting married next year and my photographer only accepts bank transfers or cheques however I wanted to pay by credit card so that I had at least some insurance on it. Would I have any come back if something goes wrong?

  • I have seen her work and its great but I know you can't rely on just that! Also by credit card you are protected if something goes wrong with the actual venue etc on the day then you are also protected. It also protects you to the full amount even if you have just paid the deposit in case you have to change last minute etc.

    You can't make him accept a credit card payment he has explained what is acceptable to him the decision is yours you either pay the way he wants or find another photographer.

    section 85 doesn't protect you from things going wrong; it's not an insurance policy

    it does give some protection against the contract being unfullfilled
    and so it useful but it's not a general insurance policy against things going wrong.

    I wasn't really asking them to take alternative payment. And with a credit card they are jointly responsible for purchases therefore if anything does go wrong then I can make a claim through them (which is an insurance to some degree!).
    What I was really asking was is there any protections if you write a cheque or carry out a bank transfer?

    No protection through your bank. Of course, there are legal channels you could go down if they don't provide the good/services you paid for, but more difficult to enforce than when the bank is jointly liable. You should be aware, as CLAPTON succinctly stated, that the Section 75 Credit Card only covers the non-provision. It doesn't cover you if you agree to pay the photographer on a non-refundable basis, and then the wedding moves to a different time/place.

    It might be the photographer is unaware of newer ways for them to accept credit cards. If so, making him aware of services like iZettle, and offer to pay extra to cover the transaction fee.

    It just appears that you are confused as to how much protection you actually get. Protection under Section 75 is for breach of contract by the person you are paying, for example if the photographer didn't turn up and wouldn't refund you, he went bust and wouldn't take the photos for you or the photos supplied were of an objectively poor quality. It would not help if, as you suggested, something goes wrong with the venue, or otherwise if you can't use the photographer's services or you changed your mind and don't want to use them.

    It's not insurance, it's a legal remedy should your photographer screw you. That's it.

    None at all. Your only remedy if he broke the contract in this case would be small claims court.

    If you pay by VISA debit card, VISA will support a charge back in some cases although it they are no legally required to do so.
    I'm not sure about Mastercard debit cards and anyway it isn't a substitute for insurance.

    The safe way is only to pay once the photographs have been taken and printed and you are happy with the results, at which point you can pay by either method as you won't have any concerns.
