    They are being deliberately obstructive!

    Dear ticketers

I write in reference to invoice xxxxxx , and your subsequent emails/letters. Please note that an appeal has been submitted to you, and you are being deliberately obstructive in not providing a popla code. So there is no confusion the appeal is as follows

    1) This is not a genuine pre-estimate of loss
    2) Your signs are not clear so contravene the bpa Code of Practice
    3) You do not have authority or a contract to give these invoices out

Now be advised that a complaint has been sent to your trade body the bpa, and the dvla as you are not complying with the Code of Practice, and you are not allowing the legal right to popla.

Make up your minds what you want to do, this is the last time you are being asked to either allow this appeal or supply a popla code. If you do not provide it within 14 days the matter is deemed closed and accepted by you!

    Sincerely

Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Totally agree, this is shocking! Complain about them!

BPA and DVLA addresses are in the sticky thread 'newbies...read this now!'.

  • Ditto stroma and CM - Unbelievable !

You've now requested a POPLA code twice -once in your original appeal and the second rejecting their reduced offer (their choice). You are appealing against any charge not whatever figure they choose to drum up next.

Make sure that in your complaint to the BPA and DVLA that you emphasise they are attempting to deny your legal rights to complete the independent appeals process and that they still attempting to coerce a payment from you when appealing the charge.

Yes, it seems that, in their 'mad World' they reckon they could come back and offer £20, then £18, then £15, etc...all the time saying 'we haven't rejected your appeal'!!

    OMG this is ridiculous obfuscation.

    "Dear Sir/Madam,

Thank you for your email in regards to the above parking charge.

Please be advised we are only able to issue a POPLA code when an appeal has been rejected.

In this instance your appeal was not rejected therefore we are unable to issue you with a POPLA code.

Your charge has been reduced to £25.00, this remains outstanding.

If you can provide us with any mitigating evidence to support your appeal, we will of course look into this for you.

Please do feel free to contact us with any other questions/queries you may have.

    Regards

    Athena ANPR Ltd"

These good for nothing morons have sent me the same constructed message again!

I am amazed by their attempt to avoid sending a POPLA code. I have emailed them back noting that they sent me the same message twice and i will be forwarding these messages to the relevant body and I am for the third time rejecting their bloody reduced offer!

you just could not make it up !!!

well done for standing your ground, I am sure you have the full backing of everyone on here in pursuing this to the bitter end, that you obtain a POPLA code , that the BPA kicks them over it and that you win at POPLA , costing them money in the process and making them feel like idiots (if that is at all possible). Finally, that it actually costs you nothing , zilch , nada

Are you now past 35 days since you submitted your appeal to them?

Have you done so? If not, do it NOW. Give the BPA all the information and tell them to investigate this clear breach of their Code of Practice.

Send the 3 responses you have had, to the BPA and DVLA and ask 'how is this an example of 'driving up standards' in this shoddy industry when (in flagrant disregard to POPLA rules as recently reiterated in the POPLA newsletter) they are refusing to issue a POPLA code and just faffing about offering lower amounts, pretending they 'haven't rejected the appeal yet' and expecting a new appeal from me each time. Mr Dunford do you agree with me that this is not acceptable; why should I write for a third time to beg my POPLA code?'

...send it to Steve Clark of the BPA and David Dunford of the DVLA, email addies on the NEWBIES sticky thread.

Here's the POPLA newsletter if you want to quote it at them:

Hi - my older thread was quoted by CM on the first page, they kept refusing me the code too, but do keep on at them....

Their letters are non compliant, and they know it...

    Good luck.
