faulty goods rights. advice needed

I bought a camera in january of this year. it was first used properly over the summer where on viewing the pictures you could see a fault with the lense. i took the camera in in september and the shop sent it to samsung to be repaired. the camera came back with notes saying the problem had been found and repaired. on using the camera for the first time after getting it back the problem is still there. nothing has changed. ive taken the camera back in and its being sent back to samsung for another repair.
i asked the shop what happens if when it comes back again the problem is still there. they just shrugged their shoulders and I said what if they keep fobbing me off until the warranty expires.
so could someone advise me as to my rights if the camera comes back again unfixed.

Legally as its over 6 months from purchase, you'll either have to rely on their warranty or may have to obtain an independent report stating the fault is inherent and not caused through misuse/wear & tear. The report costs should be refunded by the retailer if found in your favour.
Once you have this report, you can request a repair, replacement or refund (which can be partial to account for usage had) but the retailer can refuse if it is disproportionately costly. This is why they tend to repair, as its cheaper.
However, repairs should be carried out at no cost to the consumer, within a reasonable time and without causing significant inconvenience.
How long are the repairs taking? You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
The first repair took about 10 working days. they have sent it off again today. so ill see how long it takes this time. i could just do with finding out what i can say and do if the faults still there again. the warranty card says at samsungs descretion they could either replace or repair. but what can i say to the retailer0

What exactly was the error/fault?1. Have you tried to Google the answer?
2. If you were in the other person's shoes, how would you react?
3. Do you want a quick answer or better understanding?0 -
The lense is faulty on the camera producing blurring in shots0

Did you buy it from a camera shop, or just some store that sells things it doesn't know anything about?
Did the shop fire off any test shots before sending the camera away?
Did the shop ask to see sample photos showing the problem?
Does it occur with every photo?
The lens may be out of alignment, or there could be other reasons, but if the shop hasn't made a few basic check before sending it away to Samsung, then you're not going to get very far.
If it wasn't a camera shop, then try to find a proper local camera shop and ask them to take a look at it. Take along a memory card with sample images on it. Expect to pay them for their time.1. Have you tried to Google the answer?

If it goes over a certain amount of time it will be replaced, this is 28 days out of your possession (from when you leave it in store to when it's delivered back to the store) if it's a case like this where it's not been fixed then the 28 days continues so long as there is no break of 7 days or more between repairs or informing them of the problem.
As you're over this period it's classed as a new repair and the time limit starts again, and as a camera is a luxury item you cannot argue significant inconvenience and 28 days for a camera repair is also (imo) within a reasonable timeframe for repair.
Again as far as the "warranty" goes it's either 3 months from last repair (same fault) if taken into store or end of the "warranty" whichever is longer.0 -
Thanks for your help. so do i have any legal rights if it comes back again not fixed interms of asking for a replacement0
-
Legally No, however they should swap after 3 failed repairs0
