G24 parking notice received

I received a NTK on 24/10/13 for an offense that happened on 05/10/13. I have been looking at all the information so that I can decide what to do next but I am so confused with all the advice.

As I did not receive the NTK until 19 days after the offense I thought that I could send G24 a letter stating that they had not sent the NTK to me within the 14 day timescale but I have been advised that this is not the case.

I have been to speak to the manager at the store where the incident happened but they were not really interested and told me to speak to G24.

I'm not sure what to do next. I know that there are similar posts on here but they all seem to have different advice.

Any advice you can give would be warmly welcomed

    What was the date on the NtK. Some PPCs backdate their NtKs? It is the date on the NtK that counts, I am afraid and they blame the postal service for delays.

    Apart from that, are you ok with your appeal letter to them if NtK complies?

    You are doing well so far.

    As they have not sent the NTK within 14 days they can only pursue the driver, and not you, the registered keeper.

    [edit. as guys dad says, they may say they sent the letter earlier. did you keep the envelope, and does it have a date stamp? I have had several letters from G24, and all had a date stamp on the envelope. Several of these are dated 1 or 2 days after the date on the letter]

    Furthermore, if they imply the RK is liable then they are committing an act that the DVLA and the BPA frown on, and may actually ban them.

    Appeal to G24 in the third person on any grounds.

    I am the registered keeper. I appeal your ticket on the grounds that the signage is deficient.

    When you get your POPLA code, appeal on the grounds that the NTK was served out of time so they can only pursue the driver.

    Add in that they do not have a contract with the landowner and that their charge is a penalty an not a true pre-estiamate of loss, just for luck.

    Date on the NTK was 18/10/13. It was sent in an unmarked envelope by UKmail.

    I read somewhere that UKmail deliver their post next day (according to their website), so that would mean that they didn't post it until 23/10/13 some 18 days after the "offence"

    Also another question I have is....on the NTK they are asking me to pay £100 (£60 if I pay within 14 days), however when I visited the store yesterday to see the manager, I checked out the G24 signs and they said that the fine was £90. Will this be of any significance as my NTK is incorrect?

    Guys Dad, I may just need some pointers about what to put on the soft appeal. I saw this letter on parkingcowboys website which asks the PPC to provide the contract between them and the land owner and wondered if I should throw that in

    And if it was the first PCN (ANPR PCN?) then you are correct, it has arrived too late for registered keeper liability. Make sure you reply ONLY as the registered keeper, not inferring who was driving!

    Say also that the signs are pants and that they made no loss by the driver parking there, and that you want a POPLA code or cancellation of the spurious charge.

    For a parking 'crime' on 5th October the NTK should have been delivered no later than 20th if they wished to rely on keeper liability as per POFA 2012. So even if it was actually posted on the Friday 18th October it will not be deemed to have been delivered until two working days later i.e. Tuesday 22nd October & thus too late. Now they can only pursue the driver whose identity they don't know unless you tell them.

    Does the NTK mention POFA?

    Yes it says that the parking charge has been issued in accordance with POFA 2012

    Good! They are stuffed then. You can tell them to go swivel & also send a strong complaint to the DVLA & BPA Ltd as G24 must be aware that their NTK could not possibly be delivered in time so their quoting of POFA 2012 when it cannot apply is deceptive & verging on fraud.

    I received a PCN today from G24 for an offence on the 16th October. their issue date on their letter is the 31st October. by my reckoning this is 15 days after the offence. Can I tell them to cancel the invoice on this alone or should I go through the process of writing to B&M where we parked and to G24 to appeal the charge.
