Hi All,
I got a reply for my appeal from LCP with out giving any reference number. The reply is as follows:
I have noted the points you raised however, the DVLA has confirmed you are the registered keeper of the vehicle, if you were not the driver, please let us have the driver`s name and address and we will ensure that this notice is transferred to the relevant party.
Please be advised that the regulations surrounding keeper liability have recently changed. The protection of Freedoms act 2012 came in to force on 1 Oct 2012. Schedule 4 of the act sets out changes in legislation in England and wales regarding parking on private land and the rights and obligations of drivers and vehicle keepers, as well as the provision for a new independent appeal process.
Then the letter continues quoting Protection of Freedoms act 2012 schedule 4 :
There is no mention about their decision on my appeal or what to do next or any reference numbers.
I am thinking of not responding now.
What you guys suggest ?

Post #10 there, 19th July email from Steve Clark, Head of Operational Services at the BPA Ltd., went to all AOS members. Remind the PPC about it and the clause in the BPA CoP and demand your POPLA code or you will report them to Mr Clark.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

As I mentioned before, I have purchased a ticket and parked, but I have taken some time to buy the ticket due to technical problems in paying over the phone. This they are considering as overstay and issued a ticket.

if they have given you a rejection letter then they should have issued you with a POPLA code under the BPA rules
if this hasnt happened then write back asap (email if possible) and demand a POPLA code as per the BPA rules (it may be hidden somewhere in your letters so check carefully)
once you have a POPLA code you can put a strong letter into POPLA and win the case on various legal technicalities
but you need that POPLA code first, which it appears they havent yet supplied even though they have to do so

When I appealed against the parking charge notice, LCP replied back asking for the driver`s details with no mention about the points I have raised to appeal. All they have mentioned in the letter is that "I have noted the points you raised however DVLA has confirmed that you are the registered keeper. Then quoting Protection of Freedoms Act Schedule 4 and asking me to declare the driver`s details.
I this letter to Keeper, though they are saying that the time to pay discounted amount is over, I can still appeal and if my appeal is unsuccessful, they will advice me in writing with a unique appeal reference.
While appealing would it be good if I mention that I am prepared to pay for the time that they are claiming as overstayed ( the time taken to sort out parking ticket).

tell them you do not have to tell them the drivers details and demand the POPLA code (that is 3 times we have told you now , lol)
there are several easy templates on here you can do this with too
you can mention that the BPA allows for overstays in the case of sorting out parking charges, that you have a valid ticket, so either they waive the charge or issue the POPLA code
simple

Did you get your POPLA reference number in the end?
I appealed to POPLA and won on the grounds of no GPEOL for this stupid car park.
With this car park - they state "failure to comply" which basically means they want liquidated damages, and they can never show that £100 or even £50 is the genuine estimate of loss, so they lose at POPLA.
Doesnt matter what happened in the card park, whther you bought a ticket, or it blew off or you took too long to buy it. They dont back down, or care less, and they are prepared to spend £27 to get you your POPLA code even though they know they are going to lose.

Hi All,
Just to let you know that my appeal was refused by POPLA and the reason for assessor`s determination is as follows:
I appreciate that the Appellant did not intend to delay making payment to
park on the occasion in question. However, it remains the case that the
vehicle was parked for 60 minutes but that only 40 minutes of parking were
paid for. It was incumbent upon the Appellant to pay for sufficient time to
cover the duration of parking at the site.
I find that, by not paying for the entire duration of parking, the Appellant
became liable for a parking charge in accordance with the terms displayed.
The appeal is refused
Now, do I have any other option ?0
