This is just dragging on and on.

Excel have finally got back to me about my initial letter. They've rejected my appeal which back then was simply based on this being a ridiculous charge rather than a legitimate charge for loss of earnings. Apparently £100 is a "reasonable charge for liquidated damages in respect of a breach of the parking contract".

They also state that based on my appeal letter "it's reasonable for us to assume you were the driver", this seems a bit of a stretch to me, I specifically mentioned "the driver of my vehicle" and never said I was the driver.

As a gesture of goodwill they have offered me the reduced rate again, that might mean they're not expecting to get anything in court and are tempting me with a bit of a carrot. They've also offered me the option of appealing to POPLA. My initial letter asked them to provide me with a POPLA number if they rejected my appeal.

I'm tempted to write to them and say "take me to court or leave me alone" but I don't want to make them angry enough to actually take me just as a tester.

So if you have a POPLA code/form you now win at POPLA like everyone lese here. See the NEWBIES thread for the 'How to win at POPLA' link. Job done.

If you ignore the golden ticket of a POPLA code/form now, then I despair that this forum's message about winning at POPLA is obviously pointless.

They've not given me a POPLA code, just let me know I have the option to appeal to them and included a POPLA form.

I'll look through the sticky thread and fill in the form.

If you have got the form the will be a code on it!!!

Before u fill in form, post up your draft appeal here first , you can submit it to popla online. It doesn't need to be done on the form

You're absolutely right. I'm gonna have another look at the carpark to see how clear the signage is as well as appeal based on the fact that the NTK was delivered outside the POFA timeframe and that the charge is not a genuine estimate of loss.

I'll post my POPLA appeal here before I submit it.

    Thanks

mmmm , more haste , less speed !! why the rush ?

check AGAIN for the popla code, if you have the form then you must have the code

then do as above, post your draft appeal from notepad onto here for verification, then you can print it and staple it to the form (if posting it) or attach it to your online appeal (if doing it online)

dont make mistakes now if you have a popla code

and yes , get all the proof you can , like signage etc

if you do not have the code, my earlier draft should be good enough to get one from them

Of course the code is on the form, it's a POPLA appeal form and that's the Golden Ticket I was telling you that you had! And you won't be posting it this month will you...think about it...Christmas postal delays!...You'll not be filling the form in - you'll be submitting it online to POPLA once you've drafted a winner.

  • BenCr, rest assured now that you have the Popla code you can win your appeal. I have just had notification that my appeal against Excel has been successful. I followed advice from Coupon-Mad and it happened just like Coupon-Mad said it would. Popla basically rejected Excel's case because it was not a genuine pre-estimate of loss when Excel were trying to claim operating costs, installation costs, staff wages and just about everything else you can think of. In the reply from Popla they said that once they had decided that it was not a genuine pre-estimate of loss, Popla did not even have to consider all the other points in my appeal. Take the advice and you will win!

This is just one of the many POPLA appeals that are available here.

I am glad that you are taking the simple route and appealing with GPEOL as the main appeal point, but please use wording and layout similar to the quoted link. I has proved to be successful.
