Sam(so called manager) proved to be completely useless and as he refused to provide me with either his full name or any other person to contact I had no choice but to walk away from there.

This gym is part of DC Leisure group, so tried to fill in complaint with them online, but apparently their form doesn't accept more than 20(?) words...
    dcleisurecentres-forms.co.uk/dclenquiry.html

Will post it to their head office on Monday.

Just want to say that it wasn't a pleasant Saturday morning for both of us, with this letter in a morning post and then complete ignorance from employees of DC Leisure group. Will totally avoid their services in the future.

Definitely complain and complain about Sam as well. This is NOT ON especially as the gym never told a new member about the important matter of car parking registration of vehicles. Then compounded the issue by pretending he couldn't do anything about a mere parking agent (course he could, they can always get this harassment cancelled unless MET were actually contracted by the managing agents who run the whole leisure complex - in which case your complaint doesn't stop at the Gym, it moves to the Leisure park managing agent of course!).

I would concentrate on the complaint next week and then consider the challenge to MET only if you have to, the following week as you have 28 days.

The registered keeper, after exhausting the gym/over all leisure park manager complaint, should send a simple challenge to MET (not inferring who was driving so NOT 'I am a gym member, I parked'. Instead, the keeper should write 'the driver...' did this/that, in the third person).

But you will find all of that on the other threads on the forum, to be fair. And the complaint is your first priority as it's the easiest way to get this quashed.

    What do they say?

What I can't see from your picture is whether or not that sign is at the entrance to the whole Riverside Park complex or the actual car park.

If it is an informative sign and there is a more detailed one at the entrance to the car park, then it's that sign that counts. If there are clear signs around the car park, then let us know. Better we comment on them first rather than the PPC including them in their bundle at either POPLA or elsewhere!

Go to the google streetview link provided by the OP.

There you can see this is the only entrance sign.

There are other signs around the car park, as the OP stated, but we don't have any photos of them, or a layout diagram. You can see a couple in the distance via streetiew

GD - if you use the Google Maps link in post #10, you get a better view of the car park entrance. The only sign showing at the entrance is the Norwich City Council one.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I appreciate that. That is why I asked about any other signs.

Things are getting more interesting. Today received 2nd PCN for the same thing, different date (21/10/2013). I wonder how many more will come in, and how much 2 weeks of membership with DCL will cost us.

The crucial sign is that at the entrance. The PPCs case is that the driver entered into a contract for parking by reading the signs & parking. However it is clear point under contract law that T&Cs cannot be added to the contract afterward the contract has been entered into so whatever is written on the little signs in the car park is irrelevant compared to what is on the sign at the entrance.

So far we have 2 PCN totaling £200. Spoke to misses, she said that there might be another one coming.

On Saturday appealed to MET and on Tuesday sent a complaint to head office on chairman's name. Will see what happens next

Hi guys, just to update you with my progress.

Both PCNs were cancelled by the CEO of DCL, but it took two big fat complaints on his name to get them cancelled.

If anyone is desperate I can post my correspondence with them here.

Would like to thank everyone who helped with their advice, you are heroes!
