Euro car park hamilton vue cinema

Hi looking for some advice. I took my kids as a treat during the school holidays last week to the cinema and then for something to eat and also went to a couple of shops before leaving.today I received a pcn for £70 for overstaying in euro car park. Firstly I had no idea there was a time limit in this car park especially as I was using the facilities (cinema restaurant shops) that this supposedly free car park is intended for . i really can't afford this fine right now and feel it is very unjust what happens if I don't pay. The only number on the letter is a payment number

This is Scotland, so the advice of Ignore Ignore Ignore applies. You'll get several letters (probably) of increasing threatenance (is that even a word?
) and then they'll give up.
Whatever you do, file these letters away for safe keeping but DO NOT RESPOND TO THEM AT ALL! There is no registered keeper liability in Scotland (or NI) so if you don't respond to them there's absolutely nothing they can do.
PS - That's the cinema we usually go to. Can't say I've seen such signs for parking there (though I haven't looked). Were you in THAT car park, or the ASDA one, or the one over the road for the retail park?0 -
bod1467 is right, as this is in Scotland you can safely ignore this spurious invoice.
Do NOT contact them in any way - as that shows that you are unsure of the law in Scotland, and might be persuaded to pay by them sending letters threatening all sorts of repercussions that are impossible.
Have a search for 'Scotland' on here and you will see that in Northern Ireland and Scotland they need to know who the driver was and you are under no compulsion or requirement to tell them.
Unless you are foolish enough to tell them, they are on a hiding to nothing.0 -
Ok thanks for the replies. bod1467 yes was in the car park at cinema I've never noticed any signs but apparently max 4hrs but was in the cinema for over 2 hours then took kids to Pizza Hut then wife wanted a look in next as you can imagine this can easily take over 4hrs and didn't realise I was being timed they have photos of my reg going in and out carpark0

Thanks for the heads-up ... whilst it's not usual for us to be 4+ hours there it's not impossible.
I have a complicated position whereby I have a company car, and the lease company [registered keeper I believe] is in England, and there is a policy to pay all "fines" then pass this on to the company, who would then try to recover from my wages.
Looks like it might be time for a stern email to the company, fleet and leasing company to tell them that any Parking Charge Notices received must not be paid and must be forwarded to myself for action. (I have previously made them aware of the potential liability the company has in the car policy, if they just pay any "fines" and remove from the driver any opportunity to exercise their legal rights).0 -

And I take it you are parking in Scotland normally? So if you get a fake PCN it's none of the lease company's business as only the driver can be chased (and not actually 'caught' of course!). Bet they don't understand the difference in private parking law between England and Scotland?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

To the questions, yes and correct.
I have tried to educate them about the differences, but whether they understand is another matter.
In fact I have just sent them an email placing a line in the sand, and saying that on no account are any speculative invoices to be paid on my behalf.0 -

According to the Hamilton Advertiser the Palace Grounds Retail Park (over the road) is (or was) owned by London-based Savills. I wonder if they also own the Vue Cinema etc. plot?0

Savills have a substantial operation in Scotland, so even if they do own the place, they still have no excuse.0

I was more thinking about my own situation, as a company car driver, should a PCN ever be forwarded to me as the driver. By knowing the owners this would give me an avenue to get any PCN quashed.0
