Ok point me to the legislation where it makes this a criminal offence, as in illegal! Don't give me the fact that paying for an alleged breach of contract , or that a debt collector is actually acting illegally for trying to collect an alleged debt not originated from them.
This is what they do for a myriad of companies, collecting for parking companies is no different than collecting for any other industry. If they break guidelines they are not acting illegally but probably unlawfully, there is a distinct difference between the two.
As for people being hounded, that is not the person on the grounds fault, that is down to the company involved!
This is not an "alleged debt" that is being disputed - it simply does not exist( - it was cancelled by the creditor), a fact of which the DCA is fully aware.
Were I to send you a letter claiming to be a DCA and advising you of an intention to institute a court action if you do not pay me £160 in the next 7 days(with the knowledge that you have incontrovertible proof that no such debt exists), how would you react?
Would you view my actions as illegal?
Or maybe just Business As Usual for a DCA, no harm done because he is a DCA and that is what DCA's do?
Re the parking attendant being blameless in the whole chain of events:

Where is your proof that the dca is fully aware of this? They only can go on what they are told, if they are not informed of this they will chase you! I'm not defending them as my views of dca's are well documented on the forum, but unless you have proof of this being a criminal matter then it's not illegal.When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. You are right - I may be making assumptions here - I would have thought that in the 13 days between the receipt of the letter from the PPC advising me of the cancellation, and receiving the Notice of Intended Court Action from the DCA, the creditor who the DCA is acting for would have informed the DCA that there is no debt to pursue.
I think that the DCA's are still garnering plenty of revenue by hanging on to the bitter end - I'll wager that there are a load of people who will fold under the pressure from these guys and just pay up for a quiet life(which is perfectly understandable).
I may well have to ask the PPC for proof that the DCA were informed timeously of the cancellation of the debt, but will only do that if I get further threatograms from Debt Recovery Plus and need to take this whole thing further.0 -
If they send you further letters chasing this after you've sent them proof of the cancellation then that is worthy of a complaint. They must investigate any denial of liability with the originator, if they don't then they are acting against guidelines and quite possibly unlawfully.

Surely this is simply a lack of communication? Even the thickest Debt Collector would realise that if an alleged debtor had the debt cancelled by the PPC they were wasting their time.0
