Well it fails as a Notice to Keeper on several counts, but because your employer is best advised to write to name you (name and address) as the usual keeper/driver of the car then it will be interesting to see what UKPC then send to you. Thanks for posting this as it's good to spot the errors for starters!

On this version (did it arrive by day 15?) I can see these errors:

    - it should be called a PCN or NTK and by not using the word 'Parking' it makes it unclear what sort of 'charge' this purports to be
    - it doesn't identify the creditor, who could be UKPC, could be McDonalds, could be the Managing Agent of the retail park, or landowner, or another entity.
    - it doesn't state the contravention (you have to guess maybe they are suggesting an overstay but by how much)?!
    - it fails to tell the keeper that if, after the period of 28 days beginning with the day after that on which the notice is given—
(i)the amount of the unpaid parking charges specified under paragraph (d) has not been paid in full, and
(ii)the creditor does not know both the name of the driver and a current address for service for the driver,
the creditor will (if all the applicable conditions under this Schedule are met) have the right to recover from the keeper so much of that amount as remains unpaid.

So basically it fails to inform your employer that they will be liable if they don't provide the driver's details, which you will be able to mention in your appeal later on. In fact it fails to mention POFA 2012 at all so I am wondering if it was sent late and they aren't invoking rk liability which is interesting. Was it received more than 15 days after the event?

But it will depend as well, on what format of Notice they send to you. It will be interesting if your version they send to you mentions POFA 2012!

Bottom line - it is easiest to get McDonalds to cancel it by being fairly assertive and insistent that this is unnecessary and unjustified harassment of a customer - assuming it was a minimal overstay?

So try to do the complaint Monday or Tuesday in person. :)
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks for taking the time to look over this.

The notice was received by head office 13 days after the day of the alleged offence.

I'm visiting McDonalds today to complain.

I'll get photos while I'm there.

    Thanks

I've been and spoken to the manager, who has agreed to have the notice cancelled.

I explained I visited the restaurant on a regular basis with colleagues, and didn't realise there was a 90 minute maximum stay.

The manager said if head office had heard nothing back from UKPC in the next few days regarding the cancellation to contact him again.

So hopefully this will not need to go any further now.
