Well I only emailed the appeal yesterday. I nearly forgot completley, until I found the letter in my handbag. I really should of made myself a BIGGER note on my calandar....and Diary....and phone as I do have a medical issue which causes short term memory loss (IIH) but I didn't and I don't have a time machine (unfortunatley!) so I had to just send it there and then. Yesterday was 28 days so I got it in, in the time scale at least.
I will let you know when they come back telling me my appeal has failed!!

I think they have 35 days to accept or reject your appeal, but are supposed to acknowledge your appeal within 14 days. Sounds like Excel are doing their usual stalling tactics like C-M mentioned.0

As long as your email did include everything the acknowledgement auto response said (e.g. postal address)? Don't want to give them an excuse to pretend the email wasn't enough. Why not follow it up by email again and say you consider the matter now closed as they have not send a rejection & POPLA code in time?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Dear Sir/Madam,
I am writing in response to a letter received for the above PCN. I wish to challenge this PCN due to inadequate signage, it was unclear that this was a pay and display car park at that time.
To cover any loss I have posted a postal order for £2.50, this is for the cost of the parking and to reimburse your costs in bringing this error to my attention, you should receive this shortly. This payment is on the understanding that should you cash the postal order, it is in full and final settlement of this matter and the ticket is cancelled.
If you decide not to cancel the ticket please return the postal order, along with the POPLA verification code that you are required to provide. In addition I will require the full terms of the contract that you claim was entered into, as this is unclear. Also please advise precisely how this charge was arrived at under the contract and why my offer to cover any loss is unacceptable, as a larger amount is clearly a penalty. I will also be demanding that any contracts between you and the landowner are provided at any POPLA hearing.

I need to double check if the postal order has been cashed (it hadn't last time I looked) as it has not been returned.
Incidentally I have just returned from the canary islands and the english guy driving us to the airport was ranting about these parking fines in the UK. He said over there, they have the pay and display machines, locals NEVER use them. If the guy comes to ticket them, he tickets them all and when they get back to their car they check what time the ticket was issued. Say for example it was 2 hrs 40 mins ago then they will put in enough money to cover that (so 3 hours), attached the ticket from the machine to the penalty ticket they received and post it in to a secure hatch under the ticket machine. at the end of the day the guy goes back and collects all the tickets in the hatch, he basically 'crosses off' all the ones that have attached a ticket to cover the length of time they were parked and any that have not bothered then get sent on to the central office to be processed as a full penalty charge that needs paying. He also said all tickets/PCNs/fines on the road are charged against the car not the driver, you only pay any and all charges on the car if you come to sell it or scrap it, if you keep it for 50 yrs you wouldn't pay till you scrapped it at that point, if you only keep it 6 months you would have to pay all charges at that point. That way there not chasing people and taking them to court as the charge just sits on the car and there is no way to shift the car without clearing the cars debt!!

Gah - post typed and it's been lost....
anyway long and short of it - I received a reply last night (41 days after my email to them( saying they reject my £2.50 postal order (but have not returned it) as I have not provided them with the name & address of the driver (I did in the email I quoted above although I didn't type the words - "the driver is xxxx" ) and constantly refer me to a case of Excel Parking Vs Mr xxxx (can't remember the name) of 2013 where the guy lost and had to pay a wedge of £££ and court costs. They state again I can pay £60 by 28th Dec or £100 within 28 days. They have included a POPLA form which has a verification code on it so I guess now I need to go down the POPLA route. They say their signage is clear and in the POPLA guide lines (which I am sure said best not to do Blue and yellow and Excels signs are well, blue & yellow) and the price they are asking for accurately covers the loss they incur when people do not pay.
