Letting agent - demanding repair charges for Boiler Fan

    Here comes the email from my LA...

    .....We have had authorisation from the landlord to repair the boiler and the contractor has been instructed. Currently we are awaiting the delivery of the part which has been ordered.

    With regard to payment, the landlord continues to seek legal direction.....

    Now the question remains.. who will pay for it?

    I will be vacating the property on 21st of this month.. They have damage deposit to recover these charges...I don't know what they will do..

    Mailed them asking whether Landlord is paying for this but they (LA) replied saying ...they cannot confirm if landlord has paid...(playing safe).. :mad:

    CLS guy says... Don't worry...if they take it from Deposit.. come back to me..let them do what they want to...:rolleyes:

    for info I recently got a quote to have the fan on my boiler replaced. £180 all in.
    Debt free 4th April 2007.
    New house. Bigger mortgage. MFWB after I have my buffer cash in place.

    I think you made a mistake asking "Whether" the landlord would be paying for it.

    It sounds like you have accepted that you may be charged. Simply expect your deposit back and take action if they don't return it.

    No one on here(Unless your landlord is lurking) know's whether they will return it until it happens(or not).

    Sadly, I am not in a position to confirm that the repairs will be borne by the Landlord

    Do you know how much repair cost or what was involved ??

    I have vacated the house and here comes the email that states how much they are going deduct from my damage deposit:
    We have instructed our cleaners to do the little bits of the cleaning that I pointed out to you on the day of the check-out. This should be a minimal sum.

    He has also instructed us to deduct fifty percent of the charge of replacing the fan in the boiler, as the cost of the repair was £661.31, he has requested a deduction of £330.00.

    I have vacated the house and here comes the email that states how much they are going deduct from my damage deposit:

    Get back to the legal centre immediately and get them to write a "letter before action" for you stating you will be taking the landlord to court if the landlord doesn't refund your deposit in full within 28 days. Send the letter to the landlord directly via recorded delivery, and a copy to the letting agent.

    Then if it's not refunded in the time stated on the letter start small claims action immediately against the landlord. You will have to do this yourself but it's easy as you can do it on moneyclaimonline.

    You need all the previous letters and emails you sent and received from the letting agent.

    BTW if you haven't got the landlord's address get the legal centre to write a letter to the agent to get it.
    I'm not cynical I'm realistic :p

    I've only just read through this thread, and I can't believe the liberty the landlord is taking with claiming money from you for this!

    I am a landlord, and I would only claim repair costs against my tenents if they had been doing something really stupid, not wear and tear on the boiler. also £660 sounds an awful lot of money for a boiler repair.

    Good luck, and use all the legal advice you can find, and don't do anything vindictive like leaving a bag of fish heads behind the boiler when you leave ;)
