If you consulted a lawyer,I think he might suggest you took out the line"if you could prove the misuse,i would be happy to bear the cost".IMHO0

I had already taken it out from my letter....:D
I realised that it should not be there...
Olly300 - Can I put part of the PM in this post ..with your consent....I think someone else (and me too) might be benefited reading your valuable inputs...0 -
Good job the heating engineer was not an electician or he could not have switched the boiler off, him not being a plumber.
Oh and why did he change an electrical part? was he a trained electrician?
I wish you well in this and I really think they are just trying it on, also can you get any compensation for not have a heating/hot water service to the property?
I would add the use of an isolator should not do any damage as thats what it is "an isolator". But I do take the points made before about fans and there may be a need to have the fan run on to remove fumes ect but I cant see how turning it off would break it, it may put you at risk of CO2.
I think the moral of this story is dont say anything to anyone from the letting agent that may be used against you in the future.
EDITED
Oh they never made a repair just a report. Sorry.0 -
addictive_saver et al, a point on my PM was unethical and a breach of contract which is why I didn't post it in public.
Anyway to summarise the main part of my PM was:
The LA will either:
1. Keep hassling addictive_saver about the money
2. Give up
Then try and take it out of the deposit when Addictive_Saver leaves the property in one way or another.* (Reference to Eager Learners thread) Therefore Addicitive_Saver should take steps to minimise this but do this as honesty as possible.
* This wasn't in my PM but as the LA referred to point 42 of your contract it is clear that both the LL and LA will hide behind this at every opportunity.I'm not cynical I'm realistic
(If a link I give opens pop ups I won't know I don't use windows)0 -
If the previous tenant had been using it in the same way then you can argue any damage had already been caused.
I wouldn't go down this line of argument - it suggests that you accept that using the boiler in this way can cause damage, and you've already acknowledged that you've been using the boiler in this way... It's a kind of admission.0 -
I think reading:
http://england.shelter.org.uk/advice/advice-4083.cfm
about Taking court action over repairs my be good prep.
Shelter has some details about retaining the costs of repair work from your rent (if you have to do it yourself). But does say it is very risky (ie could be evicted).

Did the landlord have the boiler safety check done? If so, is the gas safety certificate displayed in the property?

:::Update Update Update:::
I have put all my points and informed my Letting Agent (verbally) that I would be starting with Court Proceedings and if you are okay with it.
She bluntly replied saying 'Its your wish...you can do so'
So threatening to take to court has not worked (it seems)... So I really have to start court proceedings..
Important point that I missed to put it here.. I have asked them to provide the contact details of my landlord but they have not replied to my email for last 7 days. Landlord contact details are not mentioned in the agreement.. This point can also be in the court proceedings..
For every email I am sending.. I am just getting reply saying that they are trying to get in touch with the Landlord and they will only respond once they hear something from Landlord...
I asked them to fix the boiler in the mean time...but they refused saying its a costly affair and they cannot do so until they receive 'go-ahead' from Landlord..
Me and my family have been without heating and hot water for past 15 days and these *** are still not acting on the issue..0 -

Call ARLA, call trading standards, call shelter, call the CAB & stamp your feet. If you're a woman cry a bit.;)"Mrs. Pench, you've won the car contest, would you like a triumph spitfire or 3000 in cash?" He smiled.
Mrs. Pench took the money. "What will you do with it all? Not that it's any of my business," he giggled.
"I think I'll become an alcoholic," said Betty.0
