Parking Eye without prejudice offer

Hi all, looking for some advice on a parking matter with parking eye please.

I had doctors appointment 7 months ago, there was a new parking system in place where by you have enter you car reg into a terminal at reception. Anyway I get a parking charge through for using the car park.

I explain to parking eye that I am a patient and send them a signed consent form so that they can confirm im a patient.

4 months later I get a letter saying I failed their appeal (they apparently didn't receive the consent form), so I lodged an appeal with popla.

Popla failed the appeal because there is adequate signage to warn people to enter their car details and I then receive a letter before county court claim.

I then contact the manger of the surgery and they confirm my appointment and have the fine cancelled.

Now parking eye have sent me a without prejudice offer. They say that they will cancel the fine if I pay them £27. If I don't they will take it to court.They say that they want £27 because that is what they had to pay popla and that it was my fault for not providing evidence.

The thing is, I did provide evidence. I sent them the signed consent form but they are claiming that they didn't receive it.

Obviously I have no intention of paying them anything, What do you think?

Do you think they will take it to court if I don't pay the £27?

What are my chances in court?

Any advice/input much appreciated.

    Report them the to BPA immediately. They are NOT ALLOWED to pass the fee for POPLA to the consumer.

    And reply to tell PE 'no' and that you have complained to the BPA.

    Just thank them for their offer but no thanks. If they really wish to pursue court action you'll be happy to see them there.

    If they bite, come back here and we'll help you compose your defence. DO NOT IGNORE ANY GENUINE COURT CORRESPONDENCE!

    PE really must be getting desperate now!
  • Strange how so much post goes missing when sent to PPCs. Appeals, evidence, notice of who the driver was, all strangely vanishes to the convenience of the PPC. Must be well above the national average for lost post.

    Or could it be that the PPCs are lieing and telling porkies all the time. I wonder.

    And if you get the brush-off from BPA Ltd. complain to DVLA that, despite appalling misconduct on the part of ParkingEye, BPA Ltd. has done nothing and hence is not fit to hold Approved Trade Association status - and that for as long as DVLA supplies registered keeper details to members of BPA Ltd. while knowing that BPA Ltd. is unfit for purpose, DVLA is in breach of the Data Protection Act.

    Incidentally, failing to adhere to a code of conduct to which you (ParkingEye) have committed is illegal: Unfair Trading Regulations 2008.

    Will this not just antagonise PE?

    Its just that I really want to avoid going to court if at all possible.

    Going to court is probably your ace card.
    You might as well ask the Wizard of Oz to give you a big number as pay a Credit Referencing Agency for a so-called 'credit-score'

    You could try and play them off with a threat of reporting them to the BPA or cancel the charge.
    If they refuse, you are not in a worse position.

    Forget parking eye, for now. you should be going straight to the Drs surgery with your complaints.
    To the Drs surgery, following on form my recent contact with you regarding your agents, parking eye and your subsequent cancellation of the parking charges.
    Your agents, parking eye are continuing to harras and intimidate me asking for money that you, as principal stated I do not owe.
    I would like to remind you that parking eye are your agents, and you are fully responsible for their actions, and at the moment i am considering my responses, and what actions to take as a result of this harassment, for which i hold you ( the Drs surgery) liable for as principal.

    Also while your at it, fire off a Freedom of information request and let us all have a look at the contract the NHS trust/surgery hold with parking eye.
    From the Plain Language Commission:

    They are making an offer to cancel the court action and, arguably, using the POPLA fee as a GPEOL, which it is, of course. As would the DVLA costs.

    If they had asked for £30 without breaking down the make up but saying that was their admin fee, then how could they have been reported to the BPA?

    They have made an offer to cancel any court action. You can accept it or not. If you feel confident, then reject the offer. PE have history of issuing court papers, but less history of following it through if a strong defence is entered and the surgery instructing the PPC to cancel it is pretty strong to me, but you will need other help from us on here too.
