Wrongful Accusation, Libel, Threats, Advice Please

    Does any of that matter? The OP could have just been wondering or could have been seeking advice for the friend.

    Does this lady know you are putting all of this personal information on a public forum.

    Nothing you have said indicates that she does.
    People can be identified from posts like this, it sounds as if it isn't low profile, If she doesn't, I would seriously consider deleting your post.

    A lady I know from school told me about the terrible time they've recently had.... bear with me, I'll try not not be too long winded.

    17 year old son, but of a twerp, had a bit of bother for anti social behaviour at 16, got in bother with his mum too!

    Anyhoo, gts himself a job, kitchen porter, working 10am till midnight days a week, earning well, working hard. One night after work, there was a party. He had a few bevvies, as did everyone else and he got it on with one of the girls who worked alongside him, same age.

    Few hours kip at the party address, straight to work the following day. A while after arriving home after work, two burly officers arrive. Middle of the night arrest, he admits they had sex, but she claims non consensual.

    Very distressing interview, swabs taken etc.

    The girl had previously made a similar allegation which was false.

    Four months of investigation proved that he did nothing, there were plenty of witnesses who saw them snogging, saw them go to a private room together, she retracted her statement, admitting that she led as she'd been kicked out of the family home 2 days prior to the allegation and thought her mum would have her back if she thought she'd been hurt. This succeeded initially.

    During those four months the girls mother and family threatened to burn down the home of the boys famly, threatened to rape his sister and burn her house down with her three children inside, posted on his employers facebook page comments such as 'do your customers know you employ rapists?', wrote on his oldest brothers facebook things such as 'you're a peadophile'.

    The brother's marriage was struggling, had been for over a year, and when he moved out during this period, folk were asking his wife if the reason they separated was because he was....? The lad lost his job and has been unable to find another despite applying for lots ~ though this may be unrelated, but he obviously feels it's because folk know him.

    The police of course told the other family to stop with the abuse, told the boys family just to ignore it.

    Well now all charges have been dropped, his record has been cleared, with the allegation not even been recorded.

    But I do feel this isn't fair. Had he been convicted, she'd'v e gotten compensation from criminal injuries. He may not deserve recompense as such, but he has lost his job, mud sticks, his family were threatened and libelled.

    Is there anything they can do to reverse this situation, other than learn the lessons of drunken impulse and stupidity?

    There's a number of things which can be done here, here's an outilne:

    1: Harrasment is a criminal offence, all the victims should go make statements to the police. Insist they are investigated, speak to the inspector, contact the chief constable, mp etc. Make it such a headache that they put boots on the street and make arrests.

    2: Civil recourse: Sue for Slander and Libel, get witness statements, make a claim - County Court i believe. Downside is the inital cost and the likelyhood of receiving actual payment. does this family have any assests?

    3: Get a crime number for the offence of obstructng a police oinvestigation, which is what this girl should've been charged with. If not, find out why.

    Finally go to local paper and see if they'll do a story. usually kicks people into action.

    This is really nothing at all to do with you, you weren't a witness to anything that happened, you're hearing everything second, third or fourth hand.

    Back away slowly, if a person feels that a crime has been committed they should go to the police, that's pretty much common knowledge...

    People seeking advice over sensitive problems such as this often say it is about "a friend". It doesn't really matter: what is important is to remember that millions of people read this site, including some who might live in the area and recognise the people concerned from details of the story.

    What utter nonsense....People come here for advice about what they can do ...or to pass that advice onto others. Your attitude is a poor one.

    I do wonder that if this is indeed the second time the girl has pulled this kind of a stunt why 1 The family reacted so badly (did they not know of the first instance at the time?) and 2 Why the heck with a "history" of this kind of accusation why the police aren't more pro-active. I'd be advising a friend to kick up in this situation - however as far as the lad is concerned there will always be some people who think "No smoke with fire" and mud sadly sticks. A fresh start-maybe going away to college for a bit might serve him well.
