Delay advance, should I try to claim?

Hi all

I'm just looking for guidance from other money saving experts.

I was on a flight back from Turkey on Wednesday which was delayed from 20:55 to 23:59 (we actually took off after 00:30). This was due to the power outage at Gatwick on Wednesday morning which caused knock on issues all day including our final flight of the evening. From reading all the advice I dont believe this counts as the airlines fault and therefore I dont believe I can claim but what do others think?

    what was your scheduled arrival time v's actual arrival time?
  • Was the operating Carrier of the flight a "Community Carrier", i.e. a Carrier which got its licence from a member state of the European Union?

    Do you know how many planes of this Carrier stayed at Gatwick during the morning?

    Caz - Scheduled arrival was 23:30 and we got back after 03:30.

    Germankeeper - It was with Monarch so EU carrier but I dont know how many planes in total were impacted. I believe most south terminal flights in the morning were impacted.

    So we have an EU carrier, a delay in departure of more than 3 hours, in arrival of more than 4 hours, and the distance is between 1500 und 3500 km.
    This could lead to a compensation of 400 Euro per passenger.

    But the power outage at Gatwick (and additionally some fog in the morning) should be viewed as extraordinary circumstances.
    The criteria is then that Monarch has to give evidence that it was not able to reorganize its timetables in such a way, that the delay in the evening could have been avoided, even if all reasonable measures had been taken.

    From the timetables at Gatwick one can see, that there are 6 departures of Monarch in the early morning on Wednesday and 3 further departures around 9 am. Thus 9 of their 39 planes may be involved in these circumstances, so I think it is probably true that they could not have avoided the delay in the evening. Since many other carriers were involved they should not have a change to lease a plane from another carrier.

    So I dont believe that you can get some compensation.
