Do you have proof of this payment ? on any statements .
If you do they are very unlikely to win a court case as they have no loss to be pursuing other than an illicit penalty which is against case law.

POPLA are the Kangaroo court of the century and they allow certain points for one reason only, they know they are dealing with someone that is clued up and will use the dribble they spout in court and as they like acting as fake judges, they do not want a real one reading about the Kangaroo court they are running.
    Be happy...;)

PS I would also make a written complaint to POPLA that they have cherry picked the parking companies case yet completely ignored your evidence.
You can then follow this up with a complaint to the Local Government Ombudsman as they are run by a local authority using public money>
Also ask under what re-mit they are under offering Legal services outside of Greater London.
Ask why they are using publicly funded offices, staff, equipment, electricity, heating and stationary and if the cost charged is reflecting the true cost of offering this service or is it a subsidised service .
They do not like that question.
    Be happy...;)

Called the Bunker Caf! today. The guy that I spoke with told me that the landowner of the Tower Road car park is Newquay Golf Club.
    .

By way of apology for my earlier snarkiness :o
I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.

I think we are letting POPLA off the hook to easily, they vast majority of it's decisions are seriously flawed .
Even when presented with evidence the correct fee was paid they are printing copy and paste drivel in favour of parking companies.
On POPLA wins, only a small minority they are afraid of who appeal clued up win, the others they are simply abusing and this is netting parking companies a fortune.
We should also advise those who have come here after learning the POPLA decision, not everyone finds this first.
Many of these people had paid and not breeched any made up rules yet POPLA acts like a kangaroo court at a fairground coconut shy dispute .

People given this absolute twaddle fob off by POPLA must complain to obtain the "decisions are final" stock letter and then take forward to Local Government Ombudsman scheme.
They deserve to be treated fairly by a local authority and not with deliberate dishonesty.

POPLA you are an absolute and utter shame and disgrace.
    Be happy...;)

Yes I do on my bank statement. I sent it to both Parking Eye and POPLA - as well as screen shots of my call logs to prove the times I made the calls and how long they went on for.

I've just finished my email to the golf club (the landowners)

    Thank you :)

I have now done just this. Thank you. I feel like I am finally fighting back. Complaints to both the Golf Club and POPLA have now been sent. I'll let you know of any response and will be back once I receive the next steps from Parking Eye.

How do you get the "decisions are final" stock letter? I would be interested in pushing own case to the LGO.

Yes you just make an official complaint to POPLA that they have failed in their statutory duty to a member of the public in administering your POPLA appeal by refuting your supplied evidence and accepting and selecting evidence from the parking company that this is a failure of their statutory duty as a public authority.
That you demand they investigate your appeal and re-examine your case fairly and with the responsibility to act in a manner fitting of a public authority that London Councils are a public funded body and are duty bound by the trust placed within them to act impartially and in fairness.

They will just press the orange sticker on key f7 and send the template "final" letter.
You can then move forward to the Local Government Ombudsman where you can also raise the point about what authority they have to act outside of the London boroughs they represent.
    The Answer is NONE.
    Be happy...;)
