Flightmole

I've done a search for this but couldn't see a specific thread but does anyone know if Flightmole are still trading? I've a claim with them but I've had no response to a few emails I've sent them?

    No idea but if you can't find proof, fairly readily, that they are, I would assume not.

    I hope you haven't paid them anything. If you have agreed for them to pursue your claim under a no win, no fee agreement, I suggest that you send a letter to them (maybe recorded delivery) advising them that as they haven't been answering your correspondence, you wish to terminate the arrangement. If they are not providing the service you signed up to, they may be in breach of contract. (I am making the assumption that you would have no liability for their costs to date but that may be wishful thinking.) Of course, they may be working away on your behalf behind the scenes. I don't think asking for some proof of what they are doing is unreasonable, however.

    When you say "I've a claim with them", do you mean you have had some exchanges with them which suggest they are or were bona fide or have you just asked them for assistance and had no response?

    Either way I would be looking to extricate myself from any involvement and go with someone else (if you prefer not to handle a claim yourself).

  • Many thanks for the reply. They are indeed (in theory) pursuing a claim for a group of us (8 of us in total) against Monarch and we have signed deeds of assignment to them (Aviation Loss Consultants Limited).

    As you suggested, I will send them a letter by recorded delivery asking them to advise as to where things are up to as I don't think its unreasonable that they should have at least acknowledged by previous chaser emails.

    I'll let you know how I get on but now I need to find another firm to take on the claim?

    Well it doesn't look like they are still active but you never know. I am not sure how you would go about getting a deed of assignment revoked. Do you have a copy? Does it instruct the airline to pay any compensation to flightmole? If so, it might be an idea to say in your letter to them that if you don't hear within X days you reserve the right to revoke it. How that stands up legally however, I wouldn't know, I'm afraid. Any revokation should also probably be sent/copied to the airline if they were named in/copied with the original deed.

    Are you up against any potential time limits (mainly the 6 years for bringing a case)? That would be something to watch out for.

    Re other firms, I can't advise as I am going down the DIY route but there is plenty on here about firms that are acting.

    Just a thought, maybe try the local trading standards to see if they know anything about the "company" (or individual).

    Their registered address appears to be a basement flat near Archway roundabout, but Companies House shows them to be up to date with their accounts and they were registered in 1997 so not, if you excuse the pun, a fly by night operation. If you have heard nothing at all, it is quite possible they never began your claim and you should look at the start of the Monarch forum and follow instructions.
