Orange contract - Is it binding?

I've been going through a dispute with Orange and would very much like to just walk away from the contract with no fees. I won't go through the whys with you, we'd be here for a long time discussing it.

After looking through my contract that was signed at CPW i noticed that there is a box that hasn't been ticked. The text next to the box simply says that

'I agree to the terms overleaf'

EE have said that they go on what CPW send them and if it is in correct I am to discuss it with CPW

As this box hasn't been ticked am I right in thinking that the contract is not enforceable?

    By using the phone and package I'd think that it would be deemed that you had accepted the contract and the associated terms

    You don't always need to sign the dotted line and tick every box for there to be a contract

    You enter into a binding contract whether or not a document is signed to prove it. Therefore I think you'd need to find a material term that you didn't agree to, and which Orange refuses to change, before you could get out of the contract.

    Also it was an upgrade
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    Good point. So the OP would be bound by the terms of the existing contract, if not of the new contract.

    Why upgrade in the first place?
    You knew what Orange was like because you had been with them already

    I also agree with everybody else that you used the package so you agree to pay for it.
