Missing Signs - What's to be done ?

Had the 'pleasure' of using one of the car parks 'managed' by the ANPR devices of one of our lovely PPC chums earlier today. Being a good citizen, I duly paid the appropriate fee, made sure I was in a bay, ensured I wasn't touching a white line, checked my ticket was securely fastened and not upside down etc (even took a photo of it on my windscreen as a nice memento of my visit ), checked that the wind was indeed from the east, that there was a 'y' in the day and avoided all radioactive spiders and zombies (thanks for the warning Prankster) and of course I also made sure I left before the bewitching hour.

So far so good.

Then, being an avid reader of this forum, I realised that all the members of The Old Boys Club (aka BPA) are supposed to abide by a code of conduct so they can cosy up to the DVLA. I'm sure this code states that there should be signs on the entrance to the car park .. I looked several times, even took a photo but couldn't see one. Only the usual ones 10 feet up a lamp-post in 12 point text actually in the car park.

Now, as I know times are hard in PPC land with all these POPLA wins (which you lot keep causing ... :j ) so I don't want them getting into any more trouble with their 'professional association' (honest :D) .. that's why I haven't named them. So perhaps someone out there could suggest what I should do about this non-compliance ..... sensible responses only please :) .

    Well complain to the the bpa, dvla and the newspapers. Not a lot more can be done I guess . Bet it was parking eye, they like their signs 10ft up a pole
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    I wouldn't want to be a Pole if PE came a-knocking. The thought of it brings tears to my eyes - ouch! :rotfl:

  • Thanks guys (and/or gals) ... complaint sent to whom you suggested plus the landowner .... who's already in the proverbial for inviting the infestation in the first place.

    I wait with baited breath ... probably be a whitewash response but I guess every little 'nail in the coffin' helps.
  • Not an unexpected response from The Club (see below) ... I thought it was only 'clamping' signs that had to be updated by the stated 'amnesty' period not the fact that there aren't any ....

    I'm not well enough versed in the ins and outs but no doubt you chaps and ladies will know . .:)

    Apologies if I've messed up any appeals on this car park by anyone by drawing our chum's attention to their (allowed) breach of the CoP.

    Thank you for your e mail that was passed to myself.

    We have passed your complaint to Parking Eye and received a reply back stating the signage is on their roll out plan towards October 2015 deadline.
    Due to your complaint they are bringing the site up the list as a priority.

    Entrance signs

    In essence, entrance signs are designed to tell the motorist that they are entering managed land and that terms and conditions of use will apply. The details of these terms and conditions are not put on entrance signs: they are contained on notices displayed elsewhere within and about the land.

    We recommend that you introduce this new arrangement to
    any newly managed sites immediately and other (existing) sites when re-signing takes place. In any event, entrance signs should meet the new requirements by 1 October 2015.

    We expect to receive a programme of works from you to show how you will achieve this. You should send us this by 1 April 2013.

    So why not follow up your letter to the BPA with one drawing their attention to their own CoP
    18.2 Entrance signs play an important part in establishing a
    parking contract and deterring trespassers. Therefore,
    as well as the signs you must have telling drivers about
    the terms and conditions for parking, you must also have
    a standard form of entrance sign at the entrance to the
    parking area. Entrance signs must tell drivers that the car
    park is managed and that there are terms and conditions
    they must be aware of.
    Entrance signs must follow some
    minimum general principles and be in a standard format.
    The size of the sign must take into account the expected
    speed of vehicles approaching the car park, and it is
    recommended that you follow Department for Transport
    guidance on this. See Appendix B for an example of an
    entrance sign and more information about their use


    Now, in my understanding of English, "must" is an imperative directive that leaves no choice, unlike "should" or "may".

    This directive has been around for at least a year, so I suggest that you enquire whether the BPA will instruct PE not to issue any tickets until they have installed entrance signs, or, as an alternative, give you an explanation why they are not enforcing their own code of practice on their members.

    The BPA Ltd has form for cutting their "senior" members slack in the sign department. Its only a couple of years ago that T&CP (the previous incarnation of Smart Parking - the well-known oxymoron) were given over a year to finally expunge the word "penalty" from its signs at Asdas.

    Yet more evidence - if more was needed - of them looking after their members' interests first. In a more perfect world, or one where the BPA Ltd properly acknowledged its public responsibility as the gatekeepers to DVLA data, it would direct its members not to enforce on affected car parks. They needn't broadcast the fact but it might encourage speedy compliance and would actually represent a win/win. The public wins - its more adequately warned - and so does the PPC when it jumps back on the gravy train. But its the gravy train that matters...
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

  • I'm sure it was just an oversight by PE, fortunately they did manage to install the tariff board, payment machine, usual signs in the sky and the all important ANPR cameras ... just must have forgotten the entrance sign... or they ran out of them as the car park opposite seems to have one .. easily done I suppose. Yes there is a slight hint of .... :D

    I will follow up as suggested but I just wonder if our chums will actually put a sign up ...

    I guess it depends on what comes first; October 2015 or End of Contract.
