They have until December judging by your OP , count 56 days from the ticket, then they on that part comply with pofa 2012, but they could contact you beyond that, little things like the law doesn't matter to them
OP didn't get a winscreen ticket though. How would it work if they drove off before the attendant was able to attach ticket to windscreen?0 -
I suspect the PPC might be working on the basis that as this was 'attendant booked' a NtD has been 'issued' (even though you didn't have that stuck on your windscreen or handed to you).
If this is the case, they will only now be contacting the DVLA for RK details.

The OP can breathe easy. For the purposes of POFA a valid Notice To Driver must be put on the car or handed to the person who appears to be in charge of the vehicle. If no valid NTD was given then a Notice To Keeper must be delivered within 14 days. If the PPC cannot then it's their tough luck for being inefficient.
If the the motorist drives away before the ticket is stuck on the car or handed to the driver then the PPC must deliver a valid NTK within 14 days.
Here is the relevant excerpt from POFA(4) The notice must be given:
(a) before the vehicle is removed from the relevant land after the end of the period of parking to which the notice relates, and
(b) while the vehicle is stationary, by affixing it to the vehicle or by handing it to a person appearing to be in charge of the vehicle.0 -

Not many PPCs let PoFA get in the way of 'doing business'. :rotfl:
A valid NTD was not issued at the time of the 'crime' so the PPC had 14 days to deliver a valid NTK which they failed to do. If the OP gets an NTK sometime in the next few weeks then it will be out of time & thus invalid for the purposes of POFA & invoking keeper liability.0 -
IMO - PPC's hardly ever follow rules. The parking attendant in this instance could have easily just printed out a parking charge notice after this OP left the site and then destroyed/kept the notice himself.
Many of these parking attendants are on the minimum wage and have a bonus payment for the number of tickets issued.
As this is a manned site with parking attendants on the scene, it could be difficult to prove that a notice of driver was not issued - one word against the other.
A notice to keeper could therefore still be possibly sent.0 -

Please don't assume that. I reckon they will have this down as 'PCN issued' even though that would be untrue. If they can get the data I reckon they will send a late Notice before Christmas and so you will need to start reading up about how to win at POPLA, by reading other threads. Keep that ticket, don't throw it away thinking this is going nowhere and do not try mitigating circumstances in a future POPLA appeal, you need the usual winning words you will find posted hundreds of times every month.
