out of date blue badge

just caught my car getting photographed.. asked the attendant why pointed out my out of date blue badge oops any hope or cough up? private managed car park by cms ukltd

    Just wait for the notice to keeper to arrive within days 29-56 from parking. Unless you aren't the keeper of the vehicle ??

    The blue badge scheme doesn't even apply on private land, it being out of date is not really relevant, does your disability go when it expires?
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Any hope? With a private parking 'ticket' always! :T

    The date on your Blue Badge is none of their business (the Council BB scheme isn't relevant to them) and doesn't suddenly mean you aren't disabled any more.

    As advised, wait for the Notice to Keeper to arrive in November or December and then - if this was in England or Wales - be ready to send a challenge saying that the driver was seen by the operative and clearly stated to him that the driver is still disabled (despite any date on a badge). State that to pursue the matter would be a breach of the Equality Act 2010 because a disabled bay is a 'reasonable adjustment' which is there by virtue of the Act, for disabled people, not for 'people with a Blue Badge'.

    Did CMS give you a ticket at all?

    Was this in England/Wales?

    Either way, WAIT for the postal notice as long as you are the registered keeper. Reply here when it arrives and we can help you appeal it and win.

    england robin park shopping centre wigan..no ticket given, just arrived to the car and caught him photographing everything, thanks for your advice will await the ticket.

    Yes, if a Notice To Driver is not left on the car or handed to the driver then a Notice To Keeper must be delivered within fourteen days counting the day after the 'crime' as Day 1. That's delivered not posted or dated. Assuming that your post on 12th October was the date of the 'crime' you should have received the NTK not later than 27th October i.e. today. An NTK posted by first class post is deemed delivered two working days later (unless proved otherwise) so your NTK would have to be delivered on the 25th October (last working day before 25th) which means posted on 23rd October. It looks like you are in the clear but watch out as PPCs send NTKs out late but still claim that the keeper is liable for the charge. They may also ante-date the NTK & try & claim that it must have been delayed in the post.

    They have until December judging by your OP , count 56 days from the ticket, then they on that part comply with pofa 2012, but they could contact you beyond that, little things like the law doesn't matter to them
