rent increase issue and consequences?

hi, myself and my family have been renting from a lady for 4 years now-we are in Scotland
she has never been the best to get a hold of and get any problems sorted,we once called her and she was in new Zealand!
anyway she has got her son(painter and decorater) to more or less take over the responsilbilty of the house.
in the time we have been there the a heavy double cupboard has fell off the wall as it was only installed on a plasterboard wall, my kids bedroom window has been replaced as it was leaking
more recently we have been keen to get some more jobs done due to us wanting to redecorate.
our bedroom window and living room window were leaking so were replaced-but the same sills put back on,one is damaged and causing draught now, and the window wouldn't open to begin with, when I phoned to say so, his answer was, yeah I thought that!
our porch is wooden and falling to bits and were promised repair
the living room floor has sunk and causes a draught in the gap between floor and skirting,
the living room wall plaster has got damp behind wallpaper and went all squashy and wall can be pressed in
the wallpaper on ceiling is sagging
the saniflow hasn't been serviced since we moved in and bath will only drain when we flush toilet
the bedrooms have loads of water marks where roof has let water in.
these are only the things I can think of at the min, this has been going on months
they both popped down in august and she said due to all the work she has done she would be increasing the rent!!!!
its only £25 a month so thats not the issue it is the way she did it
she told my oh that she would sell the house if she could and that we were to let her know about the increase, she wants it to start from this month(due 21st)
we have not heard back from her, and we are not contacting her, surely any increase has to be in writing
my hubby is panicking we will end up turfed out, sorry for the long post any advice would be very much appreciated

    Are you in an AST, or on a rolling contract?

    She can't just "tell you" she is increasing the rent. She has to serve an official notice, and even then you can reject the increase if you want BUT this may encourage her to issue you a Section 21 (2 months notice), as long as you're not in an AST

    Part of me says a £25 increase in 4 years sounds reasonable, if this is the only one that's been suggested, HOWEVER, if the house is in disrepair and the LL is useless, I'd suggest you move anyway as things are unlikely to improve. The sunken floor sounds especially expensive and tbh it doesn't sound like your LL is going to shell out to get it fixed anytime soon.

    I haven't read it but I would assume that like in England there are ways to force landlord to do repairs (as well as ways they have to serve rental increases).

  • Thanks guys but its not as easy to "just move". We have 2 kids and notany suitable ares for renting. We are in the proceas of saving a deposit.
    As mentioned the 25 is not an issue its landlord attitude.

    Not worth the hassle. If £25 is not the issue, say you need any increase in writing for your records, point out all the areas that need attention, then pay up........or move.

    tbh im not getting back in contact
    they know everything that needs done,
    my hubby is just worried she will turf us out, that's his main concern , however she cant just evict us can she?
