JMW Solicitors and UKPC

It would appear JMW Solicitors in Manchester are a new link in the chain of letters usually received from UKPC/DRC/Zenith. They are now writing to those who have received UKPC invoices threatening court action if the outstanding amount isn't paid.

Has anyone heard of them or know of any people who have received letters from them?

No this is new. So if they are sending a (non-compliant with the Practice Direction) 'court claim' threat then the rebuttal would be as per zzzLazyDaisy's LBCCC thread.

Was the letter headed up 'Letter Before Claim' or Letter Before Action'?

Can you post a copy of it here (blank out identifying info) OR just re-type the text.

I am getting really P*d off with solicitors sending non-compliant LBCs, it isn't rocket science to do it properly - the PD has been around since 2009 for goodness sake

I do advice people to report the solicitor to the SRA after two or three letters to the PPC (so they can show the course of correspondence as evidence that this is deliberate conduct by the solicitor and not *just* simple incompetence, but I do think the time has come to hassle the SRA about this practice at an earlier stage.

Time to update the advice thread, methinks..

    Hello LazyDaisy,

The letter was headed "Important-Do Not Ignore This Letter"

It had the usual bumpf at the start about the client and the usual attempts to get me to cough up. It then states:-

"If our client does not receive full payment from you within the next 14 days we will recommend that they issue proceedings against you and obtain a County Court Judgement (CCJ) which will incur further costs. These costs will include, but are not limited to £50 solicitors costs and £35 court claim issue fee"

It then details how they will enforce a judgement if they obtain a CCJ

Don't worry to much - report this firm to the SRA for misleading consumers and their client relationship.

Check up daisy's link to the solicitors and read their debt recovery pages.

Anyone can use JMW's pre-packaged service of a solicitor's letter for just £5 plus VAT. If I knew your real name and address I could send you a letter claiming any amount I liked! Great Pick a person Make up an amount and issue a solicitors letter for court action - what a scam.

    Dear Sirs

    Impending Court Action

Thank you for your letter of [insert date], the contents of which are noted.

The alleged debt is disputed and any court proceedings will be vigorously defended.

Please therefore provide a Letter Before Claim which complies with the requirements of Annex A Para 2 of the Practice Direction on Pre-action Conduct:

    http://www.justice.gov.uk/courts/procedure-rules/civil/rules/pd_pre-action_conduct

I confirm that I shall then submit a formal Response within 30 days of receipt.

Please note, a refusal to comply with the Practice Direction will result in an immediate referral to the Solicitors Regulation Authority for breach of the Principles contained in the SRA Handbook version 8, published on 1st October 2013.

    Yours faithfully

  • Yes Trebor send Daisy's letter - but still complain now to SRA - The letter they sent you is misleading and misrepresentation. They have not taken specific client instruction. The client UKPC have merely accessed JMW's computer system for an automated computer generated letter using mail merge for a £5 plus VAT fee.
