To see the DOZENS of other threads about this place, search the parking forum for the single keyword 'Tower' using the 'search this forum' heading. Learn how to search a forum and you can find anything on any forum!
The search this forum heading is on page one above the threads, to the right of 'forum tools'. When you search on this forum I find better results are obtained when you change the default search to 'show posts' (not show threads).

Hey.. a few month's ago, may time.. i went down to fistral beach and parked up in the car park for about a hour and ended up receiving a letter for £60 fine.. i understand it was my own fault for ignoring the sign's and not bothering to pay but to be honest i didn't realize i was there that long.. i was told to ignore the letters and they would give up..
i received 4 letters.. first telling me of the fine (£60), second being another reminder to pay the £60 by a certain date, the 3rd telling me it had now gone up to £100 and the 4th threatening with court..
then for about 2 months i heard no more so assumed they had gave up.. til today i got the county court claim from Northampton court.. which to me doesn't seem real considering the signature it printed and was confused why Northampton considering i live in Cornwall but anyway after trying to look into advice on what to do i'm completely lost on whether i should ignore it or just pay.. no idea where to start!
Seen this? Hope you managed to submit a defence and didn't just fold and pay:

Just to say, I'm the latest victim. Unfamiliar with Newquay, but wanted to visit Huer's Tower, and knew it was nr Fistral Beach. Saw a sign by the road saying 'Nearest Car Park to Fistral Beach', so parked in there. There were two parking machines near the entrance, which I read carefully. One had to key in one's Car Reg and length of time required, so paid for 3 hours. A sign o the Parking Meters clearly said words to the effect of, "Don't worry if you're longer than intended; you can pay the excess when you return". In the event, we got lost (couldn't recall which car park we were in), but eventually found it and paid the extra, which I think was 1 hour. Anyway, it was within 'limits' Now had letter from PE asking us to pay £100 (or £60 if prompt). It says nothing about us having paid any money, but says, ''... signage clearly displayed at entrance. statesthis is private land, the car park managed by PE, that max. free stay is ohrs o mins...'. We never saw this signage, and didn't even consider looking as we'd found and paid at a meter. I would be most grateful for advice on how to phrase my letter of Appeal and Complaint'.0

umm , when did you commit this nasty offence (date) ?0
-
Do not let them try to use Beavis, this is a P&D car park, you paid.
I would venture that, having been dismissed from this car park for their greed, they would not wish to face a GPEOL defence in court and will drop it as soon as you show some backbone. You never know how far you can go until you go too far.0 -
when did smart take over this ? , was this defiantly a PE ticket? , what date?0
-
Letter from PE says 17th June, 2015. (Sorry, only just saw your Q, I'm new to this Forum)0
-
Um, what do you mean by, 'having been dismissed from this car park for their greed'? Do they no longer operate it? I'm also thinking of complaining to the Golf Club, as I understand from others on this site that it's they who own the car park)0

I suspect that this might relate to ParkingEye's car parks on Tower Road, rather than Fistral Beach, Freddy. The poster has tagged onto a thread that is nearly two years old, hence the confusion.
Parkrage - I think it would be a good idea to start a new thread for your particular case.0 -
@Regulars - new thread created by Parkrage. Let this old one die - Jeez it's over 19 months old!
Don't you just wish that MSE would put an automatic 'Thread Closed' after x months of last post. I'm sure that would save some posters money, as regulars, IMHO, are far less likely to give hijacked threads the same level of input as a new, 'fresh as a daisy', case to deal with! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
