Parking eye Fistral..

Hey.. a few month's ago, may time.. i went down to fistral beach and parked up in the car park for about a hour and ended up receiving a letter for £60 fine.. i understand it was my own fault for ignoring the sign's and not bothering to pay but to be honest i didn't realize i was there that long.. i was told to ignore the letters and they would give up.. i received 4 letters.. first telling me of the fine (£60), second being another reminder to pay the £60 by a certain date, the 3rd telling me it had now gone up to £100 and the 4th threatening with court.. then for about 2 months i heard no more so assumed they had gave up.. til today i got the county court claim from Northampton court.. which to me doesn't seem real considering the signature it printed and was confused why Northampton considering i live in Cornwall but anyway after trying to look into advice on what to do i'm completely lost on whether i should ignore it or just pay.. no idea where to start! :/

  • Shame isn't it, Fistral being utterly ruined. I'll probably avoid it next time I'm in Cornwall and intend to boycott any establishment which chooses to employ Parking Eye.

    I would not ignore court papers, sticky 3 gives far better advice than I can.

    Start by reading all the other Parking Eye small claims cases on here and learn about what to do, in order to acknowledge the claim and then send a defence to the courts in time. It moves to your local court if there's a hearing in the end (sometimes PE drop the case).

    The defence requires work on your part, not ignoring it nor missing deadlines, and you need a robust defence but one you write yourself. You need to read other threads.

    Did you miss the sticky thread about small claims - that's why it's at the top.

    Did you miss the Welcome sticky thread? Links to court case wins on there.

    Did you simply search this forum for 'Northampton'? That's how to make the forum work for you; we can't type the same thing ad infinitum when it's here all the time for the want of searching a few keywords (NOT 'Parking Eye' too many results). Learn how to search the forum effectively and you can find anything.

    Only for as long as they continue to be employed by the Landholder. I am amazed at how long they have got away with this given it is owned by Cornwall Council; surely they must have a view on this.

    As I have read in all the cases, it seem that people genuinely haven't seen the signs here (particularly at Fistral). Very unclear at the entrance, perhaps, and then people stay in the car sometimes once parked so never see any other sign elsewhere.

    Fistral Beach car park (& all the other land) is owned by the local council & leased to a company called Britannic Industries which despite it's grand sounding name is actually a property development company run by a local couple called Nicholas & Linda Briant

    The lease term is 125 years although it is supposed to be reviewed every five years so perhaps the council could intervene at the next review to do something about the terrible damage these companies are doing to the Newquay & Cornwall tourist trade.
  • For the pedants, Land Registry confirms it is actually owned by Cornwall County Council. A right of access to the foreshore must be allowed to Newquay Town Council. My request for a copy of the head lease to Britannic appears to have gone missing in transit (damn that Royal Mail privatisation) so 2nd time lucky. The renewal will be interesting.

    Home of surfing....pah...home of Parking Eye complaints more like!
