They might not issue POPLA code on the sole point of no GPEOL as they know they will lose and may claim it's not a valid reason to appeal. I would back it up with having checked the signs, they fail to comply with all of the requirements of the BPA Code of Practice appendix and, therefore, are non compliant.

I thought that if they turn down your appeal and you have requested a POPLA code, they have to give it to you as per the BPA Code of Practice, or is that not the case?

It is but we've seen PPCs say 'that's not an appeal point' and the BPA agreed...

  • Capt Calculator: Have you actually viewed any of the alleged photographic evidence they purport to have against you?

the uploaded photos in links just show a car parked in a parking bay- and state this is one of the photos of the contravention??!!!

UKPC aren't the brightest bunch when it comes to taking photographs of alleged breaches. How will they be able to prove in a busy car park that you were the driver of that vehicle on the day and left the parking area?
  • Had an interesting response from UKPC following my 'forthright' soft appeal.

Basically again justifying that the signs are sufficient and drivers walking off site will be issued a PCN and if I can provide a receipt they will consider my appeal (not overturn it, but 'investigate' it) and the parking charge has been put on hold and I can still pay the reduced rate (lucky me!) for 35 days.

I could find it but it will take me hours with no guarantee of success, shall I just ask them again to cancel or send the POPLA number? If so, do I need to be wary of any particular wording?

I am starting to quite enjoy this, sadly!

Yep just write & say you have more important things to do than spend hours looking for a receipt just because a third party notorious PPC wants to see it. Say you'd rather take your chances at POPLA seeing as clearly this charge is not a genuine pre-estimate of loss and they don't own, nor have sufficient standing in, the car park. POPLA code please - or you invite them to cancel - and you would remind them that the Nov 2013 POPLA newsletter has stated that a customer must not have to 'ask for a POPLA code' as you have just been forced to do.
