Royal Mail don't guarantee that first class mail will be delivered, full stop. They won't even consider the item lost until 15 working days have past.

Bleedin' is expensive too.. Over £6 it cost me to send a letter by SD the other week. 10x more expensive than if I'd let it go first class!
Anyway, am I right in thinking that the proof of postage won't satisfy a court as it has a tracking number. This tracking number states that the item hasn't been delivered. I'm sure I've read somewhere on MSE that, in this instance, just sending it first class and getting proof of postage would be a better option?! So (as the tracking number doesn't confirm delivery, says it is still being processed), would I be better off to resend the same letter now and start over? Or send a second letter in a weeks time saying as I've not received a reply to my original letter, I will be issuing court proceedings on X date?0 -

Well, it's a double-edged sword really. In my experience of dealing with the courts (specifically the county court) Recorded Delivery definitely was acceptable, as I had Royal Mail's confirmation that the item had been signed for by the recipient. However, if there's a question mark over whether the item had actually been delivered, I wouldn't expect the court to accept it."There may be a legal obligation to obey, but there will be no moral obligation to obey.
