Thomas Cook Extraordinary Circumstances

I know that there is a Thomas Cook thread. However I think that it would be useful to have a separate extraordinary circumstances thread. They use this excuse all the time. I am due to go to court on 31/10/13. I think it would be useful to have this thread to see if the circumstances are indeed extraordinary. Please list the extraordinary circumstances here.

    Good idea. But a similar thread was started on 22/09/13, albeit for all airlines, so maybe add your example to that thread and just stick to that one rather than clutter up the forum with more threads?:-

    Was doing some research on the board yesterday after having received the defence from TC's lawyers and came across some really unbelievable reasons the airlines where giving as EC

    Hi

    Flight TCX 540 Sharm El Sheikh to Newcastle 2/6/10 - cancelled and delayed 33 hours then diverted to Manchester

    I was wondering if anyone can help me with what to do next?

    I followed the process using the templates set out in the forums.

    I have since received an email from TC stating 'Having carried out a full investigation the specific circumstances surrounding the delay to your own inbound flight were of a technical nature. These were extraordinary, in that Thomas Cook took all reasonable precautions necessary to avoid the situation, and despite our proactive measures the problem could not have been prevented. In line with Regulation 261/2004 a payment of compensation would not be considered applicable in this case'

    I have just logged a complaint with CAA, is there anything else I should be doing?

    ...and, as in the post above, the thread will get filled with non related questions.
    However, it's rather ironic that the poster @ #3 has quoted a standard TC EC...i.e. nothing! They just claim EC over half the time, don't list the reason, and when pressed, say it's a private matter that can't be divulged.

    Just initiate the claim, then NBA, then file a court claim.
    Only then will you get the true EC claim, and you can adjust your case accordingly.
