    The builder should have told you what he was doing but perhaps he assumed that neighbour had told you so just ask that this misunderstanding doesn't reoccur.

  • Thanks again for the replies. Here's another one for you. My neighbour has a Lawful Development Certificate in place for her loft.

    Essentially, along with a loft she is also building a large ground and first floor extension for which she has planning permission. As a consequence, the LDC includes the following notice under a section listed 'informatives':


    "The applicant is hereby advised that the approved Lawful Development Certificate cannot be implemented in conjunction with approved planning permission (ref removed). Further permission would be required for the combined works."

    The officer report also states: ‘Both schemes cannot be implemented at the same time without rendering the Lawful Development Certificate invalid.”



    In the past three weeks she had dug footings and erected three walls for her ground floor development, while also completely gutting her home and creating the frame for her loft. I am not a builder but this would suggest to me that she is treating the whole thing as one development. Should she now, therefore, have to reapply for planning permission?

    you seem to know a lot about the Lawful Development Certificate your neighbour has. If you think she has breached this, then speak to your local planning office. Also mention to planning office then have removed your Chimney ( which i dare say they dont have permission to do)

    You seem to be reporting similar stuff you posted in June, on two different threads.you said you were going to contact the planning department then.

    How did you know your chimney was in excellent condition, had you been up to inspect it?

    I would suspect the internal chmney breast have been removed.

    That is one conclusion to why the chimney was removed, especially if she has gutted the whole house remove the breast as it would be dangerous to leave the chimney without any support.

    I know when we had our roof re tiled when the scaffolder put up the scaffold i went up to looks at out chimney as i could see from ground level it needed pointing, but on close inspection it was showing cracks etc. I took photos and then went to show my neighbour (80 yr old) who shares the chimney and we get on really well with, she had her grandson look at the pics and then he went to look at the chimney. we agreed it would be best to try and get it replaced and split the costs. I spoke to our roofer who like us confirmed its condition and he agreed to add this to his job list and replace chimney rather that point it as originally agreed.

    so for what we saw from ground was totally different to looking close up and rather that £60 to point it, we ended up paying £210 split between the 2 of us
