New 3 contract not active with iPhone 5s

    Three may activate you but could be behind a bit on sales. Is it really worth selling the phone knowing that you could receive a bill a month down the line? If Three then connect you later and you have sold the phone you are still liable for the contract as CPW have signed documents stating the agreement... Regardless of what a mis-guided CPW rep has nudged you towards doing.

    Paying £100 doesn't mean you have bought the phone the standard cost is £549.

    I know I don't own the phone but I am going to wait a while to see what happens. The fact that cpw were ready to sign me up to a new contract under t mobile (which I refused) tells me that they surely must have cancelled the original 3 contract as it still showed as inactive on their systems. It's been 3 weeks now and still on activation on any direct debits due on my account.

    I would just take out a SIM only contract with 3 and enjoy the monthly saving :)
    If Three subsidised the handset, then this would morally be the best course of action.

    Handling stolen goods?

    You can only handle stolen goods if there's a thief.

    If anything, the OP would be the thief and the staff member that advised them to keep it would be the handler. (not saying either is actually the case)

    Selling would be dishonest and you would be guilty of theft.

    It's up to you though :p

    Personally I'd either keep on at Three or give it back to CPW.

    These things usually have a way of coming back to bite you in the !!!. Like in a month's time, when Three find the contract papers and decide to activate it, and you no longer have the phone and have spent the cash, but you have to pay the contract.

    Dishonest it may be, but if cpw hadnt have given me a prompt to take the phone and run basically, i would not have kept the handset. There is a possibility 3 will catch on, or they may not. This happened to my patner a few years ago and she was never asked for the phone back. Everyone on here is looking for ways to make or save cash and i see it as an opportunity, but i aint going to be hasty, im going to bide my time and be hopeful it does not connect. Also cpw wont take the handset back as it has slight damage.

    I'd put a three sim only nano sim in it and wait and see what happens.

    Still a good cash buy considering the stupid prices they are going for on eBay. Going to get a payg 3 sim like you said.
  • I'd be careful here as you don't have any evidence that the employee of Carphone Warehouse told you to keep it but they do have a contract signed by you.

    Carphone Warehouse get paid commission for sales by Three. They monitor their commission payments like the BBC monitors license fees so it's only a matter of time before they notice they've not been paid and take steps to fix the problem.

    They will almost certainly blacklist the phone so I wouldn't sell it on. The new owner wouldn't be able to get it unblacklisted and won't hesitate to shop you to the police.

    They may also contact you to either insist you honour the contract or return the phone and cancel. Yes an error was made but you have a responsibility to let them know this has happened so that they have a fair opportunity to fix it.

    You're best to report this to Carphone Warehouse (not the store) so that they can connect you correctly and deal with the dishonest employee. Sounds harsh for the employee but they clearly don't care about the performance of their store or customers so they deserve it in my book.
