Part time hours refused as too many existing part timers

    They've given you a valid business - they can't manage the business with any more part timers.

    Your statutory right is to make one request per year and have it seriously considered. You can't force them to agree.

    That's just it. If their reason was that the business cannot cope with another part time employee, I would understand that.
    But what they are saying is that they have a policy where the business can have a maximum of 5% part time employees, so don't want anymore.
    That surely is unreasonable as they haven't based their decision on what implications my reduced hours could have on the business, if any?

    They could have done that, and it would be nice if they did.

    But they don't have to tear up an existing policy because somebody wants to go part time.

    It's a bit like school admissions. Schools can't take 35 children just because they are all in the catchment. 5 will be disappointed as the current policy is 30 children per class.

    You've just proven my point.

    They've treated the earlier requests in the same way as yours. They aren't compelled to agree to your request because they have for others. They don't have to let everyone that wants to take leave on a given day, nor do they have to let every person that asks for part time hours have them.

    Good luck with the job search.

    But they are compelled to consider my request seriously.
    At no point have I said they have to agree my hours.
    All I want is for them to consider it seriously.

    HAVE YOU ASKED THE PART TIMERS IF ANY OF THEM WOULD PREFER TO WORK FULL TIME?

    Maybe it has been considered seriously.

    They have a policy which states only a certain percent of part time workers.

    I am sure that this policy was seriously considered after an in depth investigation as to what effect part time workers have on the business and how many part time workers the business can support without a negative impact.

    PS think Southend1 would like an answer to their pertinent question. ;)

    They are not being unreasonable whatsoever...they have a policy in place and that policy allows the business to employ a maximum of 5% part time...they have obviously met their 5% quota and too allow you to reduce your hours means they may as well rip up all their other policies.

    It's like any policy in a work place they are there for a reason and to keep accord amongst the business and employees.

    the entitlement mentality of OP is amazing, no wonder employers prefer to hire easern european workers who are happy to take whatever they're given.

    I am a business owner - not large enough to hire anyone at the moment. I have a virtual assistant who does all my admin stuff, all my web designers, website content writers are offshore workers. I am reaching the point where I need to hire a full timer to be in the office 9-5 and it scares the crap out of me.

    Hire the wrong worker and they could destroy your business. They could be like a sabateur in the organisation. Looking up what they can use to sue to company by contacting employers tribunals DURING COMPANY TIME. Documenting every word uttered by management to find anything they can use as ammunition to extort compensation.

    No wonder employers use zero hours contracts. Precisely to prevent entitled selfish brats from making their life hell

    OP is there maybe someone who is working full time but wishes to work part time that you could possible swap with?

    I do a lot of work for companies like yours - I'm an HR consultant.

    You're painting one side of the coin, which is pretty common. But actually the other side of the coin gives you pretty much all the rights for 2 years, which actually offers you and your business a lot of protection. ;)

    Other way round, but yes. OP doesn't seem to grasp that this may be the easiest solution!
