Flight Departure 27/11/13 informed of Flight Cancellation on 2/10/13,
My mine complaint is if i had Booked Manchester back in August it would have been a lot cheaper than what i paid, Every Flight out of Doncaster is at least £30 per person more expensive than Manchester.0 -

Well with those dates you have no grounds for compensation under Article 7
You need to decide if you want them to refund you, or if you want them to re-route you in line with Article 8 which deals with Reimbursement or Re-routing.
If you choose re-routing via the currently proposed route, ie Manchester, they have a clear obligation by way of paragraph 3 of article three, to transport you back to Doncastor airport on your return journey.
3. When, in the case where a town, city or region is served
by several airports, an operating air carrier offers a passenger a
flight to an airport alternative to that for which the booking
was made, the operating air carrier shall bear the cost of transferring
the passenger from that alternative airport either to that
for which the booking was made, or to another close-by destination
agreed with the passenger.
I'm assuming your rather vague " yes I did," post is an attempt to confirm that you have a return flight that was also affected ??
The problem of being transported to a different departure airport is a bit trickier due to the wording of paragraph three, specifically the phrase " flight to ".
I would argue that it is unequal treatment, which isn't really the done thing when it comes to EU legislation. The inconvenience suffered is no less in both situations due to the re-routing, yet on one flight the airline has a clear responsibility to offer assistance yet on the other they do not :cool:
You could also ask them to re-route you from Doncastor, have they simply scrapped the route ??
and do any other airlines operate the same service from Doncastor ??
You also need to weigh up the fact that Thomson pretty much always try to avoid their legal obligations, it will probably involve a bit of a fight on your part if you want them to re-route you and provide the transfer they should be providing you.

Thankyou with the help about the EU Regulations , I have now sent them a email requesting they Re-Route me back to Doncaster, They dont seem to want to give me a Address so i can put it in Writing,
I told them i would accept new flight under Protest, Thanks again .0 -

Have just heard back from Thomsons who have said i can only Claim the Re-Route back from Manchester to Doncaster if the flight had been cancelled on the actual Departure Day, What do you think ?,

That is incorrect, any prior notification only affects your right to compensation under Article 7, you are entitled to be transported to the original airport under Article 8, even extraordinary circumstances do not affect this right.

You should write Thomson a letter asking them to arrange transport between Manchester & Doncaster. Chances are Thomson won't comply but at least you have a paper trail that shows you reminded Thomson of your rights under the regulation. Such a letter will be very useful in any legal action you take in future0 -
Thank you DTDfanboy, I will give it another go , I think these Travel Companies get away with too much , People need to stand up to them.
