    I think the OP is entirely within their rights to expect a refund. They were sold a game claiming compatibility with Xbox360. It appears that the game is not compatible with some models of Xbox360, therefore the goods do not fulfil the contract and can be rejected.

    I would write to the retailer, stating the issues and giving a number of sources to back up your assertion that the game is not fully Xbox360 compatible. If they still refuse to refund (which they'd be foolish to do) I'd go to MoneyClaim Online and submit a claim. As long as you can provide reasonable proof that the game doesn't work for a number of people, I really can't see you losing.

    But is it the game that is faulty or the Xbox? I would say that if an Xbox is not able to play newer more complex games then that is where the fault lies.. not with the game.

    OP if it's a known problem with older xbox 360's it will be patched soon. If it's just a problem with your games console you're stuffed.

    I've just done a search on this issue and while there are loads of people reporting this issue there are also loads reporting that they have the original/early model 360s and are not having any issues at all playing the game.

    It's more likely that due to their age some of the consoles have failing components which can cope with more basic games but not with something as intensive as GTA5.

    If the game works on other Xboxes of similar age, then you'll struggle to claim it's not fit for purpose.

    Have you chipped your Xbox or done anything to it?
    Have you any problems with other new games?

    (I'm not an Xbox owner, but I work in IT)
    Just a thought... how fragmented is your hard disk? Because this is MS, I wonder if you have a heavily fragmented disk, so there isn't a big enough chunk of it free in one place.
    Is it possible to copy everything off the drive, then wipe it, then see if the game runs better?
    (I'm happy to be shot down if that is not possible)

    Neither are faulty.

    From the description, you are right that the problem is with the Xbox not being able to play the game. However the manufacturer stated it would work with the Xbox, and it doesn't. The description of the game is incorrect.

    Hence my analogy about the ZX Spectrum earlier. The game will never work on one. Neither the game not the computer are faulty, but whoever told you that the game would work on this platform got it wrong.

    PC games come with a minimum system requriements. If your system doesn't match that requirement then its your systems fault not the games.

    The point is all XBOX games should play on any XBOX. There are no system requirements (except sometimes about the harddrive capacity) on an Xbox game

    I've said all along it's not faulty. It just doesn't correspond to the description.

    Unlike an Xbox, there is no standard definition of PC. Although games manufacturers do print the minimum requirements for the PC on their boxes, which is another argument in the OPs favour - the fact that they didn't print such a requirement for the Xbox would suggest it works with them all.

    My PC did exceed the specs.. just, however it did not work. When I upgraded my PC it worked perfectly. So in this case the game was not faulty.

    Back to the case in hand, it seems that the game does work on older units, however it is individual cases where there is an issue.. Therefore if they had said "Cannot play on pre-20XX units" this is not the case.

    Yes in this case I expect its a fault with the OP's machine not a fault with all older generation XBOX 360's. I am just saying if it was a fault with all older generation XBOX 360's then they should refund as this issue was not mentioned the game when it was sold.
