Hi there, as someone who has been on the inside of the County Court, I would now like to go back to post number 1 posted by the OP..
Before I do that, please do not post your entire defence on here as it will be scrutinised and help them argue against it....
As I understand it, when there is a dispute between 2 parties, the courts like to see that every avenue has been explored without the need to go to court.
Now then the OP states in post 1, he received a Letter Before Claim which has been carried forward from the days of Graham White.
(This is where I get slated on here again !)
The OP sent a recorded delivery letter to GPB which was signed for by Roxburghe Debt Collectors of same address..... Why would that be I wonder.........
NO response was ever sent to that letter and the OP next received County Court Papers......
If I was the OP (and I am not) I would be pointing out to the Deputy District Judge that this is nothing more than escalation to the court, and an abuse of the court processs in order to extract money out of him.....That is clear in the absence of any response..........
The charge has gone from £100 then £160, then an offer of reduced rate.......
Under English contractual law, the land owner is only entitled to a sum of money that would put him in the same position had the breach not occurred.....
Therefore £235 is not a genuine pre estimate of actual loss and therefore it is penal and designed to intimidate into prompt payment, and therfore unenforceable in law..........
There is a case you can download on google VCS Ltd Vs Ibbottson, an appeal that was overturned on the basis that VCS had a contract to monitor parking, but had no legal right to bring proceedings as they were not the landowner......
Roxburghe cant do pofa they are debt collects.....Writing to the BPA may all be well and good but PPCs subscribe to them.0 -

Seeing as you did not thank me for the the original post, who submitted the skeleton defence you or the OP ???
OP beware !!!!0 -

I assume you have sent the OP some PM's........Oh dear!
A person that claims 35 court cases but produces no evidence whatsover, but not withstanding that, why if he should produce case numbers (but hasnt), should we buy his transcripts?
Highly suspicious activity when advice goes to PM......Should be kept on the forum.............
I hope when you are claiming your costs for 'litagant friend' they are 'actual' costs and not the running costs for your business?0 -
KIFL is a known and trusted poster on this forum. I also happen to know that OP approached KIFL by PM, rather than the other way round.
DaisyI'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -

OH !!!!!! Stop with your trolling.
Actually for your information it was combined effort of two minds. The is some logic to doing a skeleton defence first and going from there,
And thanks Daisy!
As regards to costs , the only costs ive ever asked from anyone if i turn up and help them at a hearing is petrol, i dont even ask for parking..... Not that is has anything to do with YOU. Also its highly given the company in question that the hearing will not be in my local area so doubt i will be going!Proud to be a member of the Anti Enforcement Hobbyist Gang.:D:T0 -
As I said earlier Scouser, you can be of great help in such instances as per your advice above based on your experience, but please don't denigrate to other people with a good track record of helping as well.
You can't expect to have a monopoly of advice on court cases and KIL has had a lot of thanks from people for his work. You must have recognised the regular bona fide contributors by now, so please don't undermine the real help they are giving.0 -
"To anyone receiving these letters please make a formal complaint to the OFFICE OF FAIR TRADING as Roxburghe's credit licence is still pending following investigations.
Also cited on the register is that Roxburghe also trade as PCN PARKING SERVICES. They therefore are committing acts of gross misrepresentation and fraud by issuing parking charges and then debt collection letters adding additional charges. Everyone should complain to get these scammers out of business."
