Well had a reply and you've guessed it... appeal rejected. No POPLA code though so need to send a letter back to ask for one within 14 days. Would you suggest just saying something along the lines of "I wish to appeal to POPLA please send me a code by reply correspondence." and leave it at that?

Write again and tell them you have reported this failure to comply with the BPA Code of Practice to the BPA.
Write to the BPA a letter of complaint that VCS (once again) are dragging their heels in providing a POPLA Code. Copy them in on the correspondence you have received from VCS.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

In reply to your letter dated ??December 2013. The driver will not be divulged and as the registered keeper I wish toexercise the right to appeal to the Parking On Private Land Appeals (POPLA)service and require you to provide a verification code and relevant forms.0 -
So the fact that I asked for a POPLA code should it be rejected after the first letter asking for one by return should they reject it means they have failed to abide by BPA rules?

In a nutshell.
And, in fact, POPLA has recently written in their newsletter that any rejection letter by a PPC MUST be accompanied by a POPLA code - motorists should not have to write further letters requesting a code.Please note, we are not a legal advice forum. Read that, and quote the POPLA newsletter at them, and email the BPA about it (email addy in the newbies read this first' sticky thread and in the 'successful complaints about PPCs' sticky - at the top of this MSE forum). POPLA say clearly that an appellant must not be forced to ask for a POPLA code.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Not only that but they have given 14 days to make the challenge or pay them and in BPA code of practice it recommends at least 35 days from date that rejected the challenge... help please?0

No, you've read that wrong. The 35 days is theirs, their limit to reject your appeal. You 'should' have 28 days but that's not set in stone in the law so go with their rubbish 14 days.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
