VCS Parking Charge Notice - Listerhills, Bradford

Hello everyone, this is my first ever post to this forum or indeed MSE so please bare with me...

Basically on XX September 2013 I received a parking charge notice from V/C/S for parking on their 'private car park' however... I was parked on some block paving at the side of the road to the entrance of their car park, half of my car was on the block paving half was not. I will get photo's of the place as I am going to go back today to take a photo of the location, tried to put a google earth link in but can't do it on here :-/

I will get photo's of the signs that are visible however, one is at the top of a very tall post and is difficult to read. The other which I think is very small and obscured by bushes is on the opposite side of the road to where I was parked and could relate to the other car park next to it! Basically how does road tarmac to block paving constitute a car park boundary?

Should I send them the soft letter saying that I do not intend to pay it?

Do I need to contact the owner of the building where I was parked near to see if they have a contract with V/C/S?

    So you were parked on a public road? Can you confirm that with a council please?

    1) are you the registered keeper?
    2) are you over 18?
    3) do you or vehicle live in Scotland or NI?

  • Unless you had the common sense to take a picture at the time with the ticket in place, you were parked where the ticket says you were parked and they will not hear anything else.
    So you will have to follow the usual process.
    One thing, you have now just learnt what your camera phone is actually for.

    So you were parked on a public road? That's just it, the way I see a road is tarmac or similar with a kerb next to it, which this was but half of my car was on block paving. Can you confirm that with a council please? It would fall under Bradford Council and I would need to ask them I presume?

    1) are you the registered keeper? My husband is the registered keeper, I am a named driver
    2) are you over 18? Yes
    3) do you or vehicle live in Scotland or NI? No

    And the reason I did not take photo's when it happened was because I was just leaving University in a rush to go and do an afternoon shift in A & E at a hospital 18 miles away and had about 30 minutes to get there, a ticket was not my main priority at that particular moment! but thanks for pointing this out :)
  • It won't let me upload a picture of where I was parked using Google Earth as I'm a new user, I will be taking the picture on Tuesday as I was unable to go today and can't do it tomorrow either. All help is appreciated. Thanks

    Okay you have time with this, I presume you have a ticket on the car, so wait until day 29-56 for the notice to keeper. They will write to your husband and they must be within that timeframe.

    Once you have the NtK do a soft appeal on mitigating circumstances, like didn't see the signs, I was parked on what I think is a public road, I was not in a car park. The charge doesn't reflect their loss and so on

    When you get the rejection come back here for some help with the second stage appeal with popla, we are running at a 100% success rate with them, you will not be paying this unlawful penalty if you follow advice.

  • Also if, I wait for notice to keeper will that mean that even if I appeal to them and get rejected and then to POPLA and that is refused do I have to pay the full £100 on their charge notice as at the moment if I pay in 14 days it will be £60.

    The notice was stuck to the car window in a yellow plastic pocket and it does have a bit on it saying 'Filmed' but I can't work out whether what is marked on the box is a tick or strike through as I saw no camera's or barriers...

    I know its the principle of the matter more than anything else but just want to be clear here...
  • Thank you Stroma, you are being most helpful :) I think I will do as you advise and wait for the NtK to come through and then take advice on writing a 'soft' letter to the firm and then if they don't drop it (which they probably won't) then one to POPLA.

    I think they have to write to DVLA to get the keeper's details so they are already having to shell out, is that right?
