You have no idea if it works now that he has it or not.
You need to get it back and check it from there. If he has broken it, you can make a claim in the small claims court.
Otherwise you could send out broken items, and just hold your hands up and say 'worked when I posted it guv' and the buyer would have no comeback.0 -
a lot of people use E-bay as a free parts supply for items they want to repair, simply swap the parts and send the E-bay one back.

If the buyer has admitted via the dispute system that he's had the item apart, then there is a very, very faint chance that ebay will find in the sellers favor. There was a case similar to this where the buyer tried to have it repaired without contacting the seller first, ebay found in the sellers favor. Don't hold your breath though.0

I would phone ebay and say that the buyer has had the item 6 weeks, and has voided any warranty by opening it up so you don't want it returned as it is now worthless.
See what they say. Or maybe use chat so you have a copy of the dialogue.

Maybe I've overlooked something here, but it sounds to me as though the buyer accepted the item the moment they got it repaired/changed by a 3rd party, particularly without the seller's knowledge or consent.
Since the buyer freely admits to have altered the item, I can't see how they can claim a refund against the seller."The secret of life is honesty and fair dealing.
