When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

I notice GPB are issuing this on behalf of the claimant PNC(NW) whose address is the same as GPB whose address is the same as Roxburghe.

    Hmmmm?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

This "solicitor" needs to be requested to court for questioning, let them "earn" the £50 by travelling to liverpool.

How can the solicitors have sent the 'claim form' to you then? Should have come from the Northampton court itself if a claim had been lodged....or did you mean that it was sent from the Court? If it's not from the court, direct, it could well be a spoof claim form, you can check with the Court or on MoneyClaimOnline if it was supposedly done on MCOL.

Same as in these other new threads, several comments from new posters all of a sudden which shows you that you are not alone:

    https://forums.moneysavingexpert.com/discussion/4777641

You need to write a skeleton defence to submit, so read the links from here:

    https://forums.moneysavingexpert.com/discussion/comment/63033805#Comment_63033805

Should help you get your head around it if you follow the links and open some tabs to read up on defences people have used, discussions about PPCs issuing small claims and what to do and by when. Also here is a copy of a typical 'Letter before Claim' attempt issued by GPB in August over a PCN (NW) case:

    http://s15.postimg.org/pv0802ikb/GHP_Letter_2.png

zzzLazyDaisy will tell you (no doubt) that is not a compliant LBC and so you can also argue on top of your defence points, that the 'solicitors' who should know better are sending out template letters which fail to adhere to the Practice Direction.

  • What you need to do is first thing on Monday Morning telephone the Northampton County Court and ask if it is a genuine claim form and the claim is live.....If it is not phone the police......

If it is real just submit the part of the form that states you intend to defend the claim....You don't have to write too much detail at this stage, but it must be submitted within 14 days from the date of the court stamp.....Unless you request 28 days...

The case will then be transferred to your local county court small claims track....You do not have to do anything, it is all handled by the court, then the claimant has to pay a £55 hearing fee....

This is where Roxburghe usually back out and drop it......

If I were you, I would be asking the court about the Validity of the claim and possible contempt of court as Roxburghe are GPB's Clients only, and anything else is a con

By the way, all your letters were sent by Roxburghe
  • Right, phoned the court and it is all official.

I'm going to fill in the defence form and send it off, roughly what should I be saying in the defence box?

Cheers for all the help guys!
  • I've just logged in, accepted and acknowledged the claim so I now have 28 days to submit a defence?

Nope, you have extended the time to a maximum of 28 days from when you got the papers.

To learn about defences, read all the advice on all the other similar threads that I have now linked together on Jimmy Shand's thread:

    https://forums.moneysavingexpert.com/discussion/4779596

ALL the advice on ALL the linked threads there (and any new PCN (NW) ones which pop up, look for them!) will help you - we can't keep repeating the same again for all because different threads progress at different speeds and on different tangents - so keep an eye on all those other threads and read them regularly for updates and to see the advice so far. Do ask questions on your own thread of course but from a more informed position, having read up on it all because we can't re-type everything that's already here on the forum, for want of a search.

Make a big noise in complaints as well as getting your defence in before day 28. Start by reading those threads now.

  • Well said Coupon.

Its a bit like PE, just repeating the same stuff over and and over again, easier to direct people how to look for stuff and where...
