PS&P Ltd Court Proceedings Threats

Hi everyone, a while back I received two parking fines from CPP and was advised to ignore any correspondence as they would eventually leave me alone. PS&P have been contacting me for a while and I have been ignoring them but I got a new one today. I have been on another thread with similar questions but have seen no letters like the one I received today:

"As you have failed to make payment of money owing to car parking partnership (universities), as previously requested, we are starting LEGAL ACTION through the County Court.
Seven days from the date of this letter, we intend to apply for a summons to be issued against you.
YOU SHOULD BE ADVISED THAT:
1) due to court costs and interest, your debt will increase on a daily basis
2) a county court judgement (used as a guide by stores and businesses as a guide for credit worthiness) will be issued
3) if the CCJ is executed, a BAILIFF will attend your property and remove your possessions"

It seems to be more threatening, like it is actually happening, and I really don't want a bad credit history! I'm quite nervous about is and was just wondering if this is still one to ignore? Thanks!

  • Who is this letter from? If it's from a debt collector, they are not in a position to be able to issue court proceedings. Furthermore, a summons is for criminal offences - this is not a criminal matter; how can they claim a CCJ will be issued? They would need to win first. The thread of bailiffs ("will" attend? Even if you paid?) is nonsense.

    No, this is just more bluster, and I am sure it breaks numerous rules in the manner of its language, as it's wrong, misleading and designed to be threatening. If they are really threatening legal action, it by no means satisfies the requirements of a real Letter Before Claim.

    Complete nonsense from these debt collectors!

    1) debts don't increase daily!
    2) a county court judgement is not issued, they must take you to court and win
    3) bailiffs won't turn up if a ccj is issued unless they go back to the courts, pay a fee of circa £100 to engage court appointed bailiffs, again they must win first

    Can I just say that debt collectors cannot take you to court as the debt is not theirs! I would make complaints to the oft as I believe this is unlawful.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    WE have seen this company mentioned before on here. They claim to have "doorstep collection agents" who never actually turn up at anyone's house, and they seem to be breaking the law regarding debt collectors.
    What part of "A whop bop-a-lu a whop bam boo" don't you understand?

  • I am curious as to how CPP got your name and address as they are not on the list of BPA approved operators.

    Are you a student at a university?

    Just wondering if it is a private parking arrangement between you and the university and whether you have entered into / breached a contract between you and the university?

    How did you get the first notification of the alleged parking breach? Was it a windscreen ticket and if so who from?

    Sorry for the questions, just trying to get a handle on what we are dealing with here.

    Daisy, the claims they are making must breach of Debt Collector guidance with the OFT but do the lies about issuing a CCJ and bailiffs, actually break any laws? Admin of Justice Act?

    Panic ye not! I've had these letters from these jokers several times ( and that exact same one twice!) and nothing comes of them. Firstly PS&P are the debt collectors, NOT the parking company nor the landowner so it would not be PS&P issuing any proceedings. Secondly this is all part of the standard letter chain from PS&P including, as mentioned above, threats to attend your property (they never do but I wish they would) and also letters impersonating bailiffs (which they are not) which they have been warned about by the BPA & Trading Standards so another complaint about them wouldn't go amiss. Finally, PS&P are just about the most ameteurish outfit I've ever seen given the standard of their paperwork and CPP are no better.

    Don't worry about these clowns. I've had a parking invoice going back years from CPP and the letter chain does eventually stop after 18 months or so. You've just got to put up with these abusive ( and, IMHO, illegal ) letters for a while.
