    You won't be going to court, where did you get that from?

    POPLA is a written appeal stage (not a court) that you will win, and it's easy just like kirkbyinfurnesslad said.

  • I think the op is confusing popla with a court hearing.
    I know the place in Sheffield u mean. I have got plenty of invoices from there in the past.

  • Thanks guys. It was just in response to what 'Guys Dad' mentioned re not having a case re mitigation from a court's view.

    The shops in Broomhill, Sheffield. It's actually works against the shops' interests. Most people would be put off by this incident and avoid parking there again. All the independant shops in the area will suffer lost trade as people will be directed to Meadowhall where you can park as long as you want for free!

    So is the general opinion that I should ask for a Popla code and appeal through them?

    Yep - I wouldn't pay Excel a penny. Do read those other Excel threads though as you'll have a version of a letter to use in no time!

    Whilst I'm with fighting PCNs because of the injustice of them, I think you need to weigh the options against the 'cost' of your time and effort in working through all this stuff:

    OPTION 1
    * a few hours of solid research,
    * writing a further appeal to Excel to hook a POPLA code, (maybe a chase up letter to them afterwards) - up to 35 days' wait,
    * then draft a POPLA appeal,
    * post draft up here for fine tuning
    * send appeal to POPLA (decision unlikely this side of Christmas)
    * win POPLA appeal (virtually certain with our help - 100% record so far)
    * cost Excel £27.00+VAT and the BPA Ltd around £100.00+ in running costs.
    * get on with the rest of your life

    OPTION 2
    * ignore everything
    * possible stream of debt collector's letters
    * possible solicitor's letters
    * possible Letter Before County Court Claim (don't ignore this - get back to us)
    * possible Court papers (don't ignore - advice as above)
    * possible Court appearance - Russian Roulette on the outcome
    * possible judgment against you
    * possibly none of the above will happen - you will be certain in 6 years' time
    * then get on with the rest of your life

    OPTION 3
    * whack off a cheque for a tenner
    * 'smart' for a couple of days
    * get on with the rest of your life.

    Some options to consider :). If they were chasing you for the FULL amount I'd recommend Option 1.

    I wish to raise a formal complaint regarding the above parking charge.

    The situation is that I raised an appeal with your company on [date], within the 28 days stipulated.

    You replied on [date] informing me that you require payment of an admin charge of £10 to cancel the parking charge.

    This is totally unacceptable. You must either accept my appeal and cancel the parking charge at no extra cost to me, or decline my appeal and issue a POPLA Code, in order for me to pursue the matter further.

    I expect a response from you within 14 days. If you continue to ignore my appeal I will raise a formal complaint with Steve Clark of the BPA regarding your obstruction of the appeals process and your refusal to comply with the BPA Code of Practice. I will also copy that letter to the DVLA.

    I trust that I have made myself clear.

    Cost Excel £27.00+VAT and the BPA Ltd around £100.00+ in running costs.
    That's the one I would go for.

    In fact the more appeals to POPLA - the more it costs them.
